Big Tech services will certainly retort to the proposal by saying that it's costly to maintain access and preserve user data but there's a way to address that. Email services and social media platforms must be treated as effective utilities, similar to healthcare and other emergency services.
For thanatosensitivistic features to kick in, a will from the user is normally required. However the services should offer an option for the users where the features can kick in if their accounts are inactive for five years.
In the second case, the services should only delete mailbox contents (similar to what Yahoo is doing now) instead of the accounts altogether. Account deletions can only happen if the accounts are abandoned for a year immediately after creation, or if the user choose for such.
Regarding harsh inactive account deletion policies, such practices would be restricted in the following cases:
1. It affects something you materially paid for like goods
2. Email services
3. Social media services
Basically, the proposed legislation will mandate certain Big Tech platforms to offer their users the following choices on what to do with their accounts if they die:
1. Archive/memorialization
2. Deletion
3. Transfer to other people, especially next of kins, if technically possible
The effort is gonna be herculean. Among the things to consider is the need for due diligence in order to avoid letting the intiative get hijacked by political extremists such as the far-right and so on.
