Never, ever let anyone tell you that there is no "moderator's dilemma" in the U.S. because of Section 230.

Not when it took Vimeo SIXTEEN YEARS of litigation to defeat claims that ordinary content moderation created "knowledge" or "control," hence forfeiting the DMCA safe harbor for copyright.

They spoke out against their employer. Then trade secrets law was used against them. Companies have hit whistleblowers with trade secrets suits over actions like saving code to GitHub or printing documents for remote work.

I’ve been focusing on this issue for nearly 20 years. Trade secret law is blind to the public’s interest in info, and that’s a problem. If the reporter had contacted me, I’d have focused him on that simple fact. It makes trade secret law the most powerful IP law for preventing info access.
