The EEOC’s subpoena therefore seeks, among other things, (1) the names of employees who reported antisemitic harassment to Penn; (2) the Jewish-related organizations on campus and the private contact information (personal phone number, email address and mailing address) of the employee members in each organization; (3) the private contact information of employees in Penn’s Jewish Studies Program; (4) the private contact information of employees who participated in Penn’s March 2024 listening sessions on antisemitism; and (5) the private contact information of employees who received a Penn survey on antisemitism. (Subpoena No. PA 25-07 at 5–7.)
It's just false. Here's some of the information at issue, as summarized by the district court. Hard to call 2 and 3 anything other than a list of 'list of Jews.'

The team at @democracyforward.org and Fredrikson & Byron beyond excellent. Everybody clicking on all cylinders and doing the most thoughtful and humane lawyering you could ask for. Such a phenomenal honor to be part of this team.
And our client @advhumanrights.bsky.social is doing simply incredible work. One of their volunteers filed 60+ habeas petitions in the last three months. The work that they're doing for people in need is genuinely heroic.
This victory is entirely thanks to the brave folks who testified about their experiences in detention, and the tireless lawyers who have been fighting to represent them.
Two of the people Defendants unlawfully detained at Whipple testified even after DHS refused to say it wouldn't redetain them!
This treatment has been a stain on our aspiration to be a nation governed by the rule of law. I'm humbled to have had the chance to help bring it to light and get relief to people detained without the ability to get legal advice while the government pressured them to give up their rights.
These "violations were not minor infringements incidental to confinement. They devastated detainees’ right to due process—a right upon which all others rest."

Wonderful news out of Minnesota: the district court has granted a preliminary injunction prohibiting ICE from transferring people outside of Minnesota for 72 hours after detention, and requiring access to counsel at Whipple!
