Chidester gets effective life sentence as parents of boat club crash victims share grief The ex-commodore of a Monroe County boat club wept throughout her hour-long sentencing hearing Thursday before being sentenced to perhaps the rest of her life behind bars as the parents of two siblings she killed in a drunken driving crash attempted to convey the depth of their grief. Marshella Chidester, 67, is set to spend 25 to 50 years in prison for slamming her car into the side of the Swan Boat Club in April 2024 during a children's birthday party. Chidester expressed her remorse, saying she was “so very, very sorry for the loss of your children" before Monroe County Circuit Judge Daniel White handed down the sentence. Her attorney called the term an effective life sentence at her age. Chidester was found guilty in March of second-degree murder in the deaths of Zayn Phillips, 4, and his sister, Alanah Phillips, 8; two counts of operating under the influence of alcohol causing death; and five counts of operating under the influence of alcohol causing serious injury. “I pray for them every day,” Chidester told the court. “I never meant to harm those children. I’m so very sorry, and I never ever meant to come across as not being sorrowful.” The judge said the case "might be the most tragic, the most heartbreaking this courtroom has ever seen." "This crime destroyed lives, it destroyed families, and it changed so many people in a negative way," White said. "I believe the jury got it right. The evidence of this defendant’s guilt was overwhelming.” Chidester’s attorney, James Amberg, said while the evidence in the case is “horrendous and terrible and tragic,” he wanted White to show Chidester some mercy. He emphasized that Chidester will be elderly when she is released and may only be released to a hospital to die. “I don’t know what a fair sentence looks like in this case,” Amberg said. “My client is 67 years old. She’s obviously going to prison today. But even if she serves less than the guidelines in this case, it will likely be a life sentence.” More: Dad seeks justice as boat club murder trial looms: 'I should've never let them go' Brian Phillips, Zayn and Alanah’s father, cried through his victim impact statement, wearing a shirt that said “those we love don’t go away, they walk beside us every day,” with photos of his kids on it. “What you took from me, I will never, ever get back,” he said to Chidester. “I don’t wish nothing but the worst for you, and I hope you feel what we feel every day.” The children’s mother, Mariah Dodds, said her heart is “shattered beyond words” and felt like she died inside when she learned her children had died. Dodds suffered a collapsed lung, broken ribs and other injuries in the crash. Dodds said her heart races when she hears loud noises now and panics about getting into a crash when she gets into a car. “The loss of my children has created a void in my life I will never be able to fill,” Dodds said. "My children were my everything. … They were my joy, my hope and my reason to live. They brought so much love, laughter and light into my life." Chidester cried during Phillips' and Dodds' victim impact statements. Life without parole sought Dodds said she is disgusted that Chidester hasn’t shown any remorse, and expressed a belief that Chidester is “an evil and sick individual” and is a danger to society. She asked for Chidester to be sentenced to life without parole. "She took everything in my life and destroyed it," Dodds said. "I'll be able to breathe differently knowing the actions she caused can never hurt anyone else." Dodds said her oldest son, Jayden, who was injured in the crash, had to grow up fast and was robbed of his childhood. He was in constant pain and was largely immobile, Dodds said. It took him 10.5 months to be able to walk again, and he still cannot attend school and sit for the entire day. Since the crash, Dodds said he has suffered survivor's guilt. Dodds said Jayden told her that Chidester "ruined my life. I want her to pay and spend the rest of her life in prison." During the trial, prosecutors painted a picture of Chidester as a woman who had been drinking long before the tragic crash. A party store employee testified that he sold four small bottles of white wine and a standard bottle of red wine to Chidester the morning of the crash. Her blood alcohol was later found to be 0.18 — more than twice the legal limit for driving. "She drove her car into an occupied building knowing she was unfit to drive a vehicle," Monroe County Assistant Prosecutor Ken Laurain said during closing arguments. At the time of impact, Chidester was using 100% of her accelerator, going 44 mph, Monroe County Sheriff's Office Deputy Lt. Brian Quinn said during the trial. In other words, "her pedal was to the floor," Quinn said. Chidester had not braked at all. Chidester's trial attorney, Bill Colovos, maintained that Chidester had a seizure that caused her feet to flatten right before the crash, though no medical experts testified about a history of seizures. He also raised questions about the accuracy of Chidester's blood alcohol results, suggesting fermentation caused them to be higher than they were. Colovos unsuccessfully tried to get a change of venue for trial, arguing after the guilty verdict that Chidester couldn't get a fair trial because the small, close-knit community was tainted after being exposed to "so much social media and other media."
