Jury trial is not a procedural nicety — it is a constitutional safeguard, especially in serious fraud and financial crime. If the Bill passes in its current form, that protection disappears for some of the most consequential cases in the criminal calendar. #JuryTrials #FraudLaw

MPs have voted to let the plan to restrict jury trials move forward - but the real fight may come later as MPs scrutinise the Bill in detail.

The funny thing is, you probably couldn't get 12 people to agree - without a shadow of a doubt - that restricting jury trials is a good idea.

So the proposition sort of fails its own test.

Lammy Review quote: Firstly, there must be robust systems in place to ensure
fair treatment in every part of the CJS. The key lesson
is that bringing decision-making out into the open and
exposing it to scrutiny is the best way of delivering fair
treatment. For example, juries deliberate as a group
through open discussion. This both deters and exposes
prejudice or unintended bias: judgments must be
justified to others. Successive studies have shown that
juries deliver equitable results, regardless of the ethnic
make-up of the jury, or of the defendant in question.

I can't really see the purpose of keeping #JuryTrials, it's all based on the notion of one juror somehow having doubts and refusing to accept the decision of all the others, apparently usually a few jurors lead and mostly the rest go along with them, often a Judge will accept a #majorityverdict.

The plan to abolish trials-by-jury in most cases is a distraction tactic More than 3,200 lawyers - including 300 top barristers and retired judges - have called on the government to drop a plan to abolish some jury trials on the eve of its return to the House of Commons.

More than 3,200 lawyers are warning the government not to restrict jury trials — and the evidence backs them up. The plan is a distraction tactic.

Lammy announces expanded AI use in courts alongside plans to limit some jury trials UK Justice Secretary and Deputy Prime Minister David Lammy has announced plans to expand the use of artificial intelligence across courts in England and Wales, while also moving forward with proposals to reduce the number of jury trials in an effort to tackle the growing case backlog. Speaking at a Microsoft AI event in London, Lammy confirmed that members of the judiciary are already using AI tools and said he wants to see broader adoption through increased investment in the Ministry of Justice’s in-house 'justice AI' unit. According to Lammy, AI has already been trialled in the probation system, where it has transcribed more than 150,000 meetings between offenders and probation officers, saving an estimated 25,000 hours of administrative time. Similar transcription technology is being tested in courts and tribunals. In the immigration and asylum chamber, some judges are using AI tools to help draft notes and remarks. Pilot schemes are also underway to assist legal advisers and district judges in magistrates’ courts by transcribing proceedings and summarising judgments to speed up case progression. Alongside the AI expansion, Lammy reiterated his intention to reduce the number of jury trials, arguing that there is no automatic right to a jury trial and noting that only around 3% of criminal cases currently go before a jury. He stressed that the right to a fair trial remains absolute and said that most Crown Court trials would still be heard by juries, including the majority of serious youth cases. The Law Society has urged caution, warning that while technology can help ease administrative pressures, decisions with serious consequences for individuals’ liberty and reputation must remain in human hands. Critics argue that AI should complement, not replace, proper investment in court infrastructure and staffing.

Lammy warns court backlog may keep rising despite reform package to ease pressure Justice Secretary David Lammy has acknowledged that the crown court backlog in England and Wales is expected to continue rising despite a new package of reforms aimed at addressing mounting delays. Currently standing at around 80,000 cases, the backlog could exceed 200,000 by 2035 if no action is taken, according to Ministry of Justice projections. Lammy said that although he hopes to see reductions by the next general election, substantial improvements are unlikely before the 2030s because the legislative changes will not take effect until late 2026 or early 2027. The government’s proposed reforms include removing the cap on court sitting days, expanding the use of artificial intelligence to handle administrative tasks such as transcribing hearings, and introducing so-called “Blitz courts” that group similar cases together to improve efficiency. The plan also involves scrapping jury trials for certain offences likely to result in sentences of less than three years, following recommendations from Sir Brian Leveson’s review of the criminal justice system. While lifting the sitting day cap has been broadly welcomed, the proposal to reduce jury trials has drawn criticism from opposition parties and legal groups. Critics argue that the changes could undermine the right to a jury trial and question whether the government has adequately addressed deeper issues such as recruitment, retention, and court productivity. The government has pledged £2.7bn in funding for courts and tribunals next year and increased maintenance spending to address what has been described as a crumbling court estate.
