11/21 This is how we resist. By forcing them to adhere to current policy, they either have to admit the order is against policy, and retract it, or they have to change the policies, which would open them up to litigation (which they might be already even without putting it in writing #notalawyer).

s.33 is used when <i>passing</i> legislation, not when invoking a power described within legislation, as was the case here.
If s.33 were used to pass the Emergencies Act, it would have to be reviewed and re-passed every 5 years, even if it hasn't been used.

I say it's going to be the same week his lawyer gets confirmation that he can't/won't be charged.
Either ACAB immunity, or maybe even a pardon, will let him walk.

I am #notalawyer, but there are plenty of cases like this where officers are not convicted. The better Qs to have are *why* ICE is storming left-leaning cities, why Trump appointees will frame this as "violent rioters" + "domestic terrorism," and why so much of the right will believe them.

Depending on where you live, there can be community kitchens for doing this.
Some people use them once, & hold the knowledge that they *could use them again in case anyone comes asking to see where their baked goods are made.

#notalawyer but I think the idea is that e.g. if Hegseth was charged with a crime and argued that the order was legal in because of the OLC memo suggesting the laws of war applied...even if a judge agreed with him about that, he'd still be in trouble.

Meaningless and unenforceable without defining "biological", something which the Supreme Court failed to grasp. "Self evident" is not meaningful phrase in law, I would think.
