Replace Michigan's 'obsolete' road funding rules to avoid 'more of the same,' group says Lansing — A nonpartisan research organization said in a report released Tuesday that Michigan should overhaul the way it divvies up money for road improvements as part of any push by state leaders to find billions of dollars in additional infrastructure funding. The 86-page "Data-Driven Assessment of Michigan’s Road Program" from the Citizens Research Council of Michigan described lawmakers' inability to replace the state's transportation funding law, known as Public Act 51 of 1951, as "a decades-long failure." "The bottom line is that PA 51 is obsolete," the report said. "Increasing Michigan’s road funding without fundamental reform to how it is spent would be a disservice to citizens of the state." The group's findings, which have been in the works for about a year, came amid an ongoing debate in Lansing over how to provide more money for road projects. In February, Democratic Gov. Gretchen Whitmer proposed increasing taxes on marijuana and businesses, including big tech companies, as part of a $3 billion funding plan. Last week, the Republican-controlled Michigan House approved its own $3 billion plan that would largely depend on freeing up and shifting existing state resources to roads and bridges. Before those ideas debuted, Michigan ranked 30th among the 50 states in total road funding from 2012 to 2021, according to the new Citizens Research Council analysis. However, the state was 40th in road system conditions, according to the analysis. As the Michigan Legislature evaluates its options to increase road funding, there should be a parallel effort to better understand how funding can be put to the best use, the Citizens Research Council report said. "What you do with the money matters as much as how much money you have," said Eric Lupher, president of the Citizens Research Council. "So we recognize that Michigan has been underfunding the roads, but if we don't fix what we do with the money, once we get it, we're just going to get more of the same." Nearly all of Michigan’s state road funding revenue is collected into the Michigan Transportation Fund and then distributed according to a formula set by the 74-year-old Public Act 51, according to the report. The formula is "practically impossible to understand or audit," the report concluded. A 2007 so-called "primer" on the law by the nonpartisan House Fiscal Agency is 52 pages long. For counties, the most governing allocation factor is the number of registered vehicles within a county, the Citizens Research Council report said. For cities and villages, the most governing allocation factor is population. However, according to the Citizens Research Council, the formula discounts new technology available to measure traffic, the fact that residents frequently travel to other jurisdictions, the varying cost of construction projects across the state and commercial traffic load. Michigan policymakers have more ways available to them now to understand the funding needs for roads than they did in 1951, said Eric Paul Dennis, the Citizens Research Council's associate for infrastructure policy and the lead researcher for the new report. "Things tend to be much more expensive, for example, in Metro Detroit than in Marquette, and our current distribution formula doesn't consider this," said Dennis, who is a licensed professional engineer. There are some locations in Michigan that have really poor roads, while others have been adequately funded, he added. "If we continue to put more money into a formula that doesn't really consider actual measured road funding needs, we're going to find ourselves in the same position a few years later," Dennis said. But the Citizens Research Council expert acknowledged the changes would require "difficult political discussions." Those negotiations would likely focus on areas of Michigan that should get more road funding and other places that should miss out, potentially putting lawmakers from districts across the state at odds with one another. When Republican then Gov. John Engler pushed for a 4 cents a gallon increase in the gas tax in 1997, he also insisted that the road funding formula in Act 51 be changed. The Legislature declined to reform the road funding formula but approved the gas tax hike. Lance Binoniemi, vice president of government affairs for the Michigan Infrastructure & Transportation Association, said Public Act 51 has seemed politically impossible to change. "I don't know if you ever find a scenario where you change it," Binoniemi said. Binoniemi's association represents companies that work on Michigan's roads and bridges. The state's formula hasn't been fully funded so it's difficult to tell whether it works, he argued.
