HB 3061HB 3061 & SB 2595: These dangerous anti-mask bills seek to increase criminal penalties for individuals who commit certain offenses while wearing a mask or disguise or when congregating with other individuals wearing a mask or disguise. The co-author of HB 3061 openly admits he hopes to use the bill to curtail the First Amendment Rights of protestors.
Ripe for Bias & Racial Profiling: HB 3061 recommends 180 days in jail for “offenses” that include subjective and minor acts, such as using indecent language or gestures, being too noisy on public property, or being “intimidating.” Below is a screenshot of the bill with an arrow pointing to “Sec. 42.01. DISORDERLY CONDUCT. (a) A person commits an offense if he intentionally or knowingly:” Highlighted in the bill as follows: “(1) uses abusive, indecent, profane, or vulgar language in a public place, and the language by its very utterance tends to incite an immediate breach of the peace; (2) makes an offensive gesture or display in a public place and the gesture or display tends to incite an immediate breach of the peace; … (5) makes unreasonable noise in a public place…”

It’s legal & smart to wear a mask in New York, despite NY state voting on a rule to add penalty to a criminal for concealing identity. NYC Health Department had stated that people should protect their health by masking, especially in a crowd. Thanks Riley for modeling to #StopMaskBans!
