Um... Not exactly, and not immediately. Probate follows a death, and an executor is part of that. No will = no executor: your state/Territory government steps in instead. They will take a percentage of your estate. #AdvancePlanning #EOLD

FAQ: "Do my Enduring Power of Attorney and my Enduring Guardian have to be the same person?"

Nope. They don't.

While you may choose one person for everything, it's up to you who acts for you - your executor can be the same or a completely different person altogether.

It is about looking around and realizing the person you can trust to stay calm and advocate for your wishes(yours, not theirs) in a crisis. The legal person may not be the right one.

Take some care in choosing your Health Care Representative (called by other terms in other states). The person closest to you may get overwhelmed with emotions about your situation, making it difficult to follow your wishes.
