优化交互方式让法律 AI 更精准专业 相信用过市场上通用大模型（如豆包、deepseek、kimi、千问等）的法律人都知道，直接在网页窗口中问答能得到的答案都是泛化的，甚至出现偏离很大的模型幻觉，或者模型的回答针对性不强，显然这不是法律业务 AI 应有的结果。虽然有些专业的法律人，会充分使用提示词工程（Prompt Engineering），使大模型给出的答案更加收敛和专业，但这还远远不够。 笔者通过使用大量的通用大模型，摸索出了提升通用大模型 AI 服务法律事务的方法技能。这几大技术结合提示词工程得到的结果，可以媲美甚至超过专业的法律 AI 工具。 要想法律结合 AI 获得理想的效果，必须采用一套“法律思维算法”，这套算法的核心是 IRAC 模型。IRAC 模型是法学院学生、律师和法官在进行法律分析、撰写法律意见书或判决书时最通用的逻辑框架，能够确保你的分析过程严谨、客观，且不漏掉关键细节。 IRAC 模型有四个支柱：Issue (争点/问题)、Rule (规则/法条)、Application (应用/论证)和Conclusion (结论)。其中： **1.Issue (争点/问题) ：确定案件中需要解决的法律法律争议点是什么。** 关键句式：“本案的争议焦点在于……”。这里的争议事实或问题要写精准、清楚。 **2.Rule (规则/法条)：针对上述问题，现行的法律、司法解释或判例是如何规定的。** 关键句式：“根据《民法典》第XXX条规定……”或“参照最高人民法院关于XXX的指导案例……”。这里的依据引用要准确，如果不确定，可以让 AI 进行判断。 **3.Application (应用/论证)：这是最关键的一步。 将抽象的“法条”套用到具体的“案件事实”中。** 关键句式： “在本案中……”、“结合证据来看……”、“由于……因此……”。这里最好解释大前提和小前提的关联性或者解释为什么这个法条适用于这个情况。 **4.Conclusion (结论)：基于前面的推导，给出一个明确的法律后果预判。** 关键句式： “综上所述，原告要求被告支付货款的诉求极大概率会获得法院支持。”。这里告诉 AI 结论要直接，不要模棱两可，这个结论 AI 也会自动根据逻辑推理得出，这是 AI 设计时与生俱有的能力。 前面详细描述了一套基于 IRAC 模型的“法律思维算法”，具体应用分四步： **1.提供“结构化”的案件事实。** 法律的生命在于细节，告诉 AI 以下要素和信息： * 主体关系： 谁和谁签的合同？（个人对公司，还是公司对公司？） * 核心事实： 发生了什么？（具体的违约行为、时间点）。 * 诉求： 你想要什么？（赔钱、继续履行合同、还是解除合同？）。 * 证据情况： 你手里有什么？（微信截图、转账记录、录音、纸质合同？）。 **2.指定你的“角色”与“立场”。** 法律分析往往具有立场性，要求 AI 站在不同的视角进行分析，例如： * “请站在原告律师的角度，帮我寻找对方的法律漏洞并列出要点。” * “请站在法官的角度，分析这个案件中我方证据最薄弱的地方在哪里。” * “请站在被告律师的角度，帮我寻找反驳对方的事实和法律并列出要点。” **3.利用“两步法”进行深度分析。** 不要直接跳到结论，命令 AI 按照法学界的标准逻辑 IRAC 模型来回答： * Issue (问题)：梳理本案的关键法律争议点。 * Rule (规则)：引用具体的中国法律条文或司法解释。 * Application (应用)：将条文具体应用到你的事实中，进行严密论证。 * Conclusion (结论)：给出最终的建议。 **4.纠偏与反馈。** 如果发现 AI 引用的法条已经废止（例如引用了已被《民法典》取代的《婚姻法》或《合同法》），请直接指出并让其自行修改。你可以说： “你引用的法律似乎已经过时了，请根据最新的《最高人民法院关于适用〈中华人民共和国民法典〉合同编通则部分的解释》重新分析。” 经过上述四个步骤，你可以得到即时能用的法律素材，极大的节省工作时间，AI 得出的结论和文书不仅收敛、专业，甚至基本无幻觉，这是可以媲美专业的法律 AI 工具的使用方法。用这一套方法训练法律 AI 智能体的话，得到的结果一定会极大的超越仅能过提示词工程（Prompt Engineering）设立的智能体。 ### _相关内容推荐_
