ICE Directive 11032.4 says: Generally, ICE should NOT detain, arrest, or take into custody for an administrative violation of the immigration laws individuals known to be pregnant, postpartum, or nursing unless release is prohibited by law or EXCEPTIONAL circumstances exist.
This is being violated.
Pregnant and postpartum people are being held in ICE custody, denied medical care, and are suffering under horrific conditions, despite a federal judge confirming that ICE’s own policy to prevent the detention of pregnant people is still in effect. Their human rights and dignity are being actively denied. They must be protected and released. The plan attacks women’s ambitions and promotes marrying earlier because college and careers only delay the “duty” of marriage and children. The plan blames “easy divorce” for poverty and societal decline, but the real goal is to trap women in the home. Just 60 years ago, women had to prove abuse and other wrongs before divorce. In 2024, Cherise Doyley was in labor at University of Florida Health in Jacksonville when hospital staff sought a court order to force her to have a C-section via a remote hearing. She had no attorney. In 2023, Brianna Bennett was in labor when staff at Tallahassee Memorial Hospital reached out to the state attorney to force her to have a C-section via remote court hearing. Both wanted to deliver vaginally, both were forced into C-sections, and both are Black.
The women argued that making them have C-sections violated their rights. The hospitals disagreed. In some states, court-ordered medical procedures are just one of the ways pregnant patients’ rights are restricted. The effort to chip away at those rights is rooted in the concept of “fetal personhood” — that a fetus has more rights than the woman sustaining it.
Pregnancy is the only condition where Florida courts have ruled that a patient can be forced to undergo unwanted treatment. Even a state prisoner on a hunger strike has more rights to make medical decisions. Those rulings give the state vast control over pregnant women. Read the full story at propublica.org
