The Rent Board has updated all petition forms to improve digital accessibility and simplify instructions for all parties involved. Additionally, at their March 2026 meeting, the elected Rent Board updated several key regulations (525, 1205, 1210, and 1242) to create more comprehensive e-filing processes for petitions—parties can now clearly designate if they would like to communicate with the Rent Board and each other about their petition case by email.

4. Your rent ceiling and your rent are not always the same (you rent can be lower). But if your rent is more than your rent ceiling, talk to a housing counselor about how to get a refund.

2. Rent ceilings can change in two ways: the AGA & petitions. Most rent ceilings are increased annually by the Annual General Adjustment, a percentage set by the Rent Board. Otherwise landlords must go through the Rent Board petition process to raise the rent ceiling.

There are two types of coverage under Berkeley's Rent Ordinance: Fully covered (Rent controlled, eviction protections, interest on security deposit to be paid to tenants annually), Partially covered (NOT rent controlled, but yes eviction protections and interest on security deposit to be paid annually)

Fully covered units (rent controlled): most multi-unit properties built before June 1980 and single-family homes with current tenants who moved in before 1996.
