I love the smell of PCAs in the morning!
Smells like my first appellate victory in my triumphant return to state court!

It’s a (zoom) Argument Day in the 5th DCA!
And in honor of my return to state court, after 26 years as a Fed, I’m wearing my Florida socks!

“Hey, you win some, you appeal to a higher court some.”
Or as Rocky says: “Bad bad bad.”
Note to Self:
*Two* full Cuban coffee coladas—equally wr-wr-wr-ong.
An unexpected consequence of returning to private civil practice, after years at the USAO, is that all the cases I’m citing in my briefs have names like “Consolidated Assocs. LLC, ex rel. Estate of Jones v. 621 Ocean Drive d/b/a Group Partnership Ltd., Inc.”
I miss typing “United States v. Smith.”
Florida courts are starting to require notice in any pleading “prepared with the help” of “generative A.I.”
Younger, hipper people tell me “generative” means it supplied text, not just research.
But it’s not clear to me that it’s defined well enough to exclude any use of AI for initial research.
Ok, making a triple espresso was a mistake. That was on me. My bad. I won’t d-d-do it ag-g-gain.
Well worth a read.
And the best way to win an issue in an appeal? To win it first in trial court.
Appellate lawyers—not just for appeals, anymore.

It’s an outstanding litigation firm, and I’m excited to work with my great colleagues there, and share appellate tips and practices with the wonderful appellate and legal community here.
After 25 years at the USAO-SDFL Appellate Division, and a lurker on #AppellateTwitter and #AppellateSky, I’m pleased to share that I’ve joined Kluger, Kaplan, Silverman, Katzen & Levine as Co-Chair of the firm’s newly launched Appellate Practice.
