7/ What do we want next?
💪🏽 Australia needs a robust mandatory code to:
• Align with or surpass the WHO European model law.
• Cover marketing practices from pregnancy to 60 months.
• Include penalties for violations.
• Eliminate aggressive marketing practices.
6/ The Australian Government has finally accepted the need for stronger regulation. A mandatory code is essential to stop inappropriate marketing of infant formula and better align with international standards, like the WHO Code.
5/ The ACCC acknowledged that MAIF does not apply to retailers, and its signatories are still free to advertise toddler milk products. These gaps have made the MAIF Agreement ineffective at protecting breastfeeding rates and public health.
4/ • No restrictions on toddler milk advertising—a major loophole for cross-promotion of infant formula.
• Weak oversight of modern digital marketing practices and an ineffective complaints process.
3/ • Public detriment outweighs benefit: The ACCC found MAIF is not delivering enough public benefit to outweigh its weaknesses.
• It’s voluntary and self-regulated, which means little accountability.
2/ Why does this matter?
The MAIF Agreement has long been criticized as ineffective in protecting public health and breastfeeding rates. Here are the highlights of the ACCC’s decision:

1/ The ACCC has denied the Infant Nutrition Council’s bid to continue the MAIF Agreement. In March 2024, the INC sought authorisation to renew the voluntary, self-regulated marketing framework. This week, the ACCC rightly denied their application. 💜

🧵1/ Yesterday, BAA represented mothers at the Parliamentary Friends for Maternal Health forum in Canberra, highlighting the NSW Birth Trauma Report.
Speakers emphasized continuity of care as key to reducing the lifelong trauma many mothers experience from birth.
Erasure of ancestral knowledge has negatively impacted mothers and infants. The effects are still felt today.

In 2025, we’re sharpening our focus to drive change while protecting, normalising, and supporting breastfeeding.
