It was such a pleasure to co-author this piece with a great UGA Law student, N'Guessan Kouame, critiquing the most recent Alien Tort Statute (ATS) case, Coubaly v. Cargill. brill.com/view/journal...

In other words, to find adjudicatory jurisdiction, the court required that the plaintiffs, who were *children* at the time of their enslavement, procure detailed information about the supply chain that exploited their non-consensual labor.

Sit with that a minute.

Assuming that was possible, plaintiffs then had to: (1) identify all the farms where the plaintiffs had worked; (2) fully identify the farmers who owned and controlled those farms; and (3) plausibly allege that the farmers supplied cocoa to the importers or “clearly identified intermediaries.”

Dismissing the ATS claim brought by former child slaves in Cote D'Ivoire against MNCs, including Nestle & Cargill, the DC Court of Appeals held the plaintiffs to impossibly high evidentiary standards. It required that they define the venture in which the importers allegedly participated.

Int'l lawyers often discuss how states generate new procedures/norms w/ the assumption that this marks progress. The Trump administration (through tariff threats) is socializing US forced labor bans. Below, I've written why I think this marks a setback in int'l law.
