Ombudsman Complaint

Hello Ms [redacted],

I am hoping you can either reply to this email, or call me back on [redacted], so that we can progress your request for our Department to coordinate a meeting at the property with Community Housing Limited (CHL) and to review any outstanding issues at the property.

As I suggested previously, I would encourage this meeting to be recorded and that you have an advocate with you. If you haven’t already obtained an advocate through the Ombudsman, then perhaps the information on our website will help, which includes a link to an Agency/Advocate Consent Form.

Hello Tony

As I advised in my most recent email to you on 31st October 2025, attached herein for your ease of reference: “Yes, I would appreciate you coordinating, as you kindly offered in your original email dated 15th October 2025, the necessary meeting with the State Operations Manager at CHL to review the outstanding issues at the property. I do not have an advocate through the Ombudsman WA and am not aware of any such service being available through their office. If the Department has advocacy services available for which I am eligible, I will gladly accept their involvement.”.

I was under the impression that the Department had been progressing the matter following my email, as was the Ombudsman WA in their correspondence to me. Please advise what progress the Department has made between 31st October 2025 and now.

You know it's bad when CHL and the WA government are, for the second time in 3 years, withholding independent evidence of negligence & significant liability. It was the same with the building report in 2022 that identified $25k in urgent repairs, now it's asbestos lab results.

An email from me to my housing officer at CHL on 14th November 2024 that reads:

Hi [redacted]

Even if we could afford the discounted fee, which we can't, it takes several weeks to complete a full vaccination course. Additionally, the wait time for appointments is typically weeks and there are often vaccine supply shortages. Cat Haven's website estimates a 5-week process, not including appointment wait times or supply issues. At this late stage it doesn't look like Fred will be vaccinated in time to be accommodated anywhere by Christmas even if we were to receive an unexpected windfall.

I am urgently trying to go into debt to replace our portable air conditioner so I can avoid literal heat stroke inside my house. CHL won't even commit to improving the energy efficiency of the property by replacing the insulation that was removed from the caving in ceiling once that ceiling is replaced, let alone paying for energy efficient split systems to reduce how much it costs us to make this place livable.

Vaccinating my cat according to CHL's schedule following the abrupt decision to finally relocate us and undertake major works at the property more than 2 years after the building inspection does not rate at all in my list of urgent financial priorities. We can't even afford to meet my immediate medical costs, and my health remains my immediate priority.

Clearly the date of 27th November, which has always been tentative at best, is not practicable for works to be undertaken at the premises because CHL has failed to secure alternative accommodation beforehand. I have no timeframe to give you for when Fred will next be fully vaccinated while our circumstances remain as they are, so I can't commit to rescheduling to any particular date. Let me know if anything suitable comes up on the transfer list in the meantime.

Regards

Morning Claire

Our direction is to continue with the work as planned on the 27th November, which will of course include replacing any insulation that is required.

[redacted] has spent significant periods of time ringing around, making every effort to accommodate you possible, and we are not in a position to allow a cat to hold up the works any further – as you stated, it’s been more than 2 years.

In relation to split system or any other kind of air conditioning, this is not supplied by CHOs or the Department on any social housing properties south of the 26th parallel.

Thanks,

Hi [redacted]

I don't know what you expect or what want me to do about it. We live in poverty, there's a cost of living crisis, I've been having surgery and recovering from it, I spent time in a psychiatric ward, and I've had health problems on top of health problems because of stress. I only ever tentatively agreed to the 27th in good faith with the caveat that I couldn't guarantee we would be able to do it given our circumstances.

I don't have the money to pay for vaccinating my cat and I warned you it would cause problems finding accommodation from the beginning. I certainly feel bad for [redacted] being made by her managers to waste her time and effort chasing up things I already told her would not be possible. Accommodation should have been the first thing arranged, not the last.

Nobody has confirmed that the insulation in the kitchen will be replaced at any stage. It has been missing for 5 years, and every summer I get heat exhaustion because the indoor temperature at this house reaches and exceeds 40 degrees Celsius. I have tracking data to prove it, which I have provided to the media in the past. I have never paid to live in house with such poor temperature control. I'm not postponing replacing the portable air conditioner for this when it's a health issue for me.

I again ask that you work with me rather than against me in dealing with this because my mental health is still dicey and I have gone to every effort to work with you at great cost to myself. Difference being, I don't get a salary or employee assistance program for any of this.

Regards

Hi Claire,

We have received confirmation from [redacted] that on the 12th of March, [redacted] arrived with a qualified and licensed asbestos removalist. Therefore, you were not entitled to refuse access on the basis that you are not qualified to assess the credentials of contractors appointed by CHL.

We will be issuing another 72-hour notice for our contractor to attend. If you deny access once more, we will have no choice but to issue a breach notice for the above reason. Should you continue to refuse entry, we will also need to inform the Department of Communities from a liability perspective. Please ensure access is granted as required.

Hi All

There was only one person who knocked on my door on 12th March 2025 and that person identified himself as [redacted] from [redacted] Pty Ltd. [redacted] has previously confirmed to me in a phone call that he does not hold an asbestos removal or assessor license. Where CHL officers continue failing to exercise due diligence in ensuring undertakings comply with Work Health and Safety law my options are to either exercise this duty myself or suffer being indefinitely exposed to hazards. After 6 years of the latter, I now insist on the former.

This would not be the first time [redacted] or someone else at [redacted] Pty Ltd has lied to cover themselves in any dispute or a dispute specifically related to asbestos management at this property; I have made multiple formal complaints to CHL about this behaviour and CHL chooses to continue giving them jobs and money. This is ridiculous in a technological age when many people, even poor people, have doorbell cameras or other video surveillance at their homes.

Moving forward, if you want me to deal with [redacted] at all considering their ongoing misconduct you will procure a licensed asbestos removalist and assessor who will have their qualifications and work orders checked at the door. Otherwise, you will procure contractors from outside [redacted] because they will have no reason to lie, and I can trust that they are not making false representations to protect their own interests.

Hi All There was only one person who knocked on my door on 12th March 2025 and that person identified himself as [redacted] from [redacted] Pty Ltd. I am drafting an application for court orders to get this matter dealt with appropriately. If CHL manages to succeed in sending the appropriate contractor for the appropriate work I will gladly grant them access to the premises and cease this action. Anything to the contrary will result in me issuing a breach notice to CHL for interfering with my quiet enjoyment (being the reasonable peace, comfort, and privacy) of the property and I will add a request for compensation to my court application.

I have been regularly updating the Department myself on CHL's ongoing failure to ensure urgent repairs are carried out by a suitably qualified repairer, and I will continue to do so. It is CHL incurring liability here in addition to the continuing liability from inadequately managed asbestos in 2019, not me. Just send a licensed asbestos removalist to remove the piece that fell off, encapsulate the remaining eaves, and a licensed asbestos assessor to inspect the premises including taking samples. I am not having a repeat of the [redacted] ordeal from 2019.

Regards

I am so fucking tired, there are no words. The Department has so far only escalated my complaint to the manager of the business service area responsible and I have otherwise received no response. Community housing is a fucking scam, do not vote for it.
