Pour ce médecin, l’avenir du Dr Thévenot à la tête du CROM Occitanie ne fait pas de doute : « J’ai déjà connu des affaires où des médecins se sont retrouvés dans la même situation. Dans l’immense majorité des cas, les confrères obtempèrent quand l’Ordre prend une décision qui les concerne, car, se mettre en contravention avec le code de la santé publique, c’est extrêmement dangereux. » Pour ce médecin, le secrétaire général du CROM Occitanie a « 21 jours pour organiser les élections à compter de la décision de la chambre disciplinaire. Donc, s’il n’y a pas de nouveau président du CROM Occitanie le 24 septembre prochain, cela voudra dire que le poste sera vacant ». Si le Dr Thévenot refuse malgré tout de quitter ses fonctions, « ses décisions comme président pourraient être contestées pour illégalité, car il aura exercé une fonction qu’il n’avait plus le droit d’occuper », complète Maître Abratkiewicz. Quant aux autres membres du conseil, ils pourraient « saisir le Conseil national de l’Ordre pour faire constater la vacance du poste ». Enfin, en dernier recours, « il sera possible de saisir le Conseil d’État (en contentieux) pour excès de pouvoir si le conseil local refuse d’appliquer la loi », conclut l’avocat. Reste à savoir ce que fera le Dr Thévenot. Contacté par le Midi Libre qui estime qu’il est « sur la sellette », le médecin n’a pas exclu de faire appel devant le Conseil d’Etat.
