Rechtsmissbrauch: Der EuGH erschwert das DSGVO-Hopping Schon ein erster DSGVO-Auskunftsantrag kann rechtsmissbräuchlich sein, hat der EuGH entschieden. Die Hürden dafür bleiben aber hoch.

Der EuGH sagt, dass missbräuchliche DSGVO-Auskunftsanfragen abgewiesen können. Sogar schon die erste Anfrage, wenn es nur darum geht, Schadenersatz zu erlangen. Das Gericht macht damit einen umstrittenen Aspekt des #digitalomnibus obsolet, mit dem die EU Datenverarbeiter vor Missbrauch schützen wil.
