The 2 judges outweighed 1 on a 3-judge panel of the #USCourtOfAppeals for the #FifthCircuit. The 150 were #DistrictCourt judges within the same and other Circuits - at a lower level than the #USCA. Appellate courts are higher than trial courts, everywhere, as they should be.

Sorry, but if you scrutinize the #TenCommandments, the text is a bit outdated and those that want them displayed in classrooms worship a god in Washington and bear false witness all the time.

Today, the full Fifth Circuit Court of Appeals heard en banc oral arguments in two consolidated cases challenging state laws requiring public schools to display the Ten Commandments in every classroom including our Louisiana case, Rev. Roake v. Brumley.

The #fascist #FifthCircuit has issued yet another terrible decision: they say books in public libraries are "government speech," and the government can ban books from libraries on a whim, with no constitutional scrutiny and no recourse for the public.
The current Supreme Court obviously isn't […]

The Fifth Circuit erred in dismissing the detainees’ appeal for lack of jurisdiction. Appellate courts have jurisdiction to review interlocutory orders that have “the practical effect of refusing an injunction.” Carson v. American Brands, Inc., 450 U. S. 79, 84 (1981). A district court’s inaction in the face of extreme urgency and a high risk of “serious, perhaps irreparable,” consequences may have the effect of refusing an injunction. 16 C. Wright, A. Miller, & E. Cooper, Federal Practice and Procedure §3924.1, pp. 174, 180−181 (3d ed. 2012) (quoting Baltimore Contractors, Inc. v. Bodinger, 348 U. S. 176, 181 (1955)). Here the District Court’s inaction—not for 42 minutes but for 14 hours and 28 minutes—had the practical effect of refusing an injunction to detainees facing an imminent threat of severe, irreparable harm. Accordingly, we vacate the judgment of the Court of Appeals

The Fifth Circuit Court is enabling this. It’s a stark reminder of how deeply corrupted our judicial system has become. It's a brazen attempt to rewrite history and protect those who incited the January 6th insurrection. #FifthCircuit #JudicialOverreach #January6thInsurrection

The #FifthCircuit Court of appeals struck down a gun ban to 18-20 year olds because in the 1700s 18 year olds were allowed to have guns. Maybe we should let alcohol be sold to minors, minors work in factories, etc cuz that’s “tradition”. These morons are brainwashed and hold great judicial power.

Kudos to @imillhiser.bsky.social for this excellent piece on the FDA case heard at #SCOTUS today. Millhiser shows why Judge Andrew Oldham of the U.S. Court of Appeals for the 5th Circuit is, to put it mildly, a really bad jurist. #law #fifthcircuit #federalcourts www.vox.com/scotus/38752...
