"The executive order signed by the President yesterday is yet another unconstitutional attempt to make it harder for eligible voters to cast a ballot and dangerously undermines the confidence in our elections. It threatens to disenfranchise tens of thousands of eligible New Mexicans who already securely participate in our elections by mailed ballot, requiring these voters to be on a new U.S. Postal Service list that is transmitted 60 days prior to an election. This is not a partisan issue. Eligible voters have securely cast mailed ballots in our country and in our state for decades. New Mexico requires that voters wanting to vote by mail provide specific voter information and receive approval prior to ever receiving a ballot. It is a process that's safeguarded by multiple levels of security including ballot tracking, administrative chain of custody requirements, and mandatory post-election, risk-limiting audits. The President has reportedly availed himself of this critical voting option in Florida while still pandering baseless claims of rampant fraud, so this cynical attack on others’ ability to vote by mail through this order is particularly troubling. The order also further jeopardizes the protected personal information of New Mexicans by requiring participation in databases that have no guaranteed levels of security and have reportedly flagged eligible voters as ineligible. It's clear that President Trump doesn't get it. The constitution and other federal laws are clear. The administration of elections is a legal responsibility of the states. My job is to fight for the security and freedom of every eligible voter in this state to cast a ballot. My office will work closely with the New Mexico Department of Justice to review the executive order and certainly will challenge it."
