MONTANA (2024), THE MONTANA SUPREME COURT AFFIRMED THAT MEPA IS ESSENTIAL TO UPHOLDING THE RIGHT TO A CLEAN AND HEALTHFUL ENVIRONMENT.
PROPOSED CHANGES HB 229: Rep. Debo Powers, D-Kalispell Intended to align MEPA with the Held decision. Renews agency ability to consider climate impacts in their environmental reviews, including carbon emissions. HB 285: Rep. Brandon Ler, R-Savage Asserts that the Legislature should control MEPA, not the courts. Would replace judicial review with legislative interpretation of the Constitution pertaining to MEPA. HB 270: Rep. Katie Zolnikov, R-Billings Clarifies remedies for MEPA non-compliance. Provides the courts with plain language to decide legal issues regarding permitting. HB 346: Rep.
