Mel Tucker, former MSU football coach, responds to civil suit as legal battle continues As legal battles continue regarding the sexual misconduct case that led to the firing of Mel Tucker, the former Michigan State football coach recently responded to a civil lawsuit in Ingham County's 30th Judicial Circuit Court. Tucker and his legal team answered April 8 to the civil complaint filed by Brenda Tracy, an advocate and rape survivor who worked with Tucker's Michigan State football team. In his response, Tucker claims that the relationship between the two parties was "consensual" and he denied all wrongdoing. A scheduling conference hearing is scheduled for 8:30 a.m. Wednesday, presided over by the Hon. Wanda M. Stokes. Tucker is represented by Carrie J. Koerber and Austin A. Zima of Abood Law Firm. Tracy is represented by Karen Truszkowski of Temperance Legal Group. In October 2023, just short of a month after firing Tucker, a Michigan State investigation determined Tucker had sexually harassed Tracy while she worked with his football team. Tracy is a rape survivor and activist who speaks with college athletics teams about sexual assault. In December 2022, she filed a complaint with MSU against Tucker that accused him of making sexual comments and masturbating without her consent during an April 2022 phone call. Tucker said their relationship and the phone call were both consensual. Tracy’s civil suit, filed in October 2024, alleges that Tucker defamed her by calling their relationship consensual, and that Tucker breached a contract by cancelling her appearance to speak with his team. She also claims the scandal caused her to lose other contracts. In a 55-page response to the complaint, Tucker maintained that the relationship was consensual and claims that "there were never any contracts executed for future speaking engagements." He also claims that any cancellation of Tracy's other contracts is "likely the result of (Tracy's) own conduct or statements." Tucker's response also alleges that Tracy violated confidentiality obligations of Michigan State's relationship violence and sexual misconduct policy, which Tracy's allegations were investigated under by the university. He alleges that Tracy "handpicked" a reporter, USA Today's Kenny Jacoby, and provided them with the 1,200-page investigation file. For weeks, the suit stalled because Tucker couldn't be found to be served legal documents. After attempting to serve Tucker at multiple addresses via mail and a process server, and even trying to serve him through his lawyers, Truszkowski obtained an order of alternate service in March. MSU under NCAA investigation for alleged violations during Tucker tenure, president says Michigan State University is under investigation for alleged National Collegiate Athletic Association recruiting violations under former football coach Mel Tucker, President Kevin Guskiewicz told The Detroit News on Wednesday. There are ongoing recruiting issues from a few years ago, Guskiewicz said when asked about an investigation during a meeting with The News' editorial board. He did not indicate the level of seriousness of the purported violations. "We're trying to make the case that this is a whole new coaching staff," said Guskiewicz, referring to Jonathan Smith, who was named MSU's head football coach on Nov. 25, 2023. The university hired Tucker as its 25th head football coach in February 2020 and fired him in September 2023, saying that he violated a "moral turpitude" clause in his 10-year, $95 million contract following a confidential complaint of sexual harassment filed against him by rape survivor and national activist Brenda Tracy. Guskiewicz said he has a meeting next week on the NCAA issue, so he didn't know "where it's landing." He declined to elaborate further. Confidentiality rules put in place by NCAA member schools prohibit the NCAA from commenting on current, pending or potential investigations, said Saquandra Heath, an NCAA spokesperson. MSU board members could not be reached for comment. MSU associate athletic director Matt Larson previously said the university "has cooperated with the NCAA." “Michigan State athletics has cooperated with the NCAA to review a potential matter concerning the football program under the former staff," Larson said, "and will continue to do so for the duration of the process. NCAA rules do not permit the university to provide any additional details at this time.” Tucker had a tumultuous tenure at Michigan State with a 20-14 record, posting his most successful season in 2021, with an 11-2 record, before falling to 5-7 in 2022. Tracy filed a complaint in December 2022, accusing Tucker of making sexually inappropriate comments to her and masturbating without her consent during a late-night phone call in April 2022. The coach argued that the relationship and conversation were consensual. A month after firing Tucker, an MSU investigation found that Tucker had sexually harassed Tracy while she worked with his football team. Tucker and his lawyers did not participate in the Oct. 5 virtual hearing but argued the resolution officer's decision was "fraught with countless legal and factual errors." At the time of his firing, Tucker was less than two years into a historic contract that MSU granted to Tucker that made him one of the nation's highest-paid football coaches and the highest-paid Black coach in all of American sports. In July, Tucker sued MSU in federal court, claiming that school leaders turned him into a scapegoat amid scrutiny about the university's poor handling of previous scandals, fueling his termination after a sexual harassment complaint without due process. MSU filed a motion to dismiss in December. A judge has not made any rulings. Tracy filed a defamation lawsuit against Tucker in October 2024. Former MSU coach’s disappearance holding up lawsuit, plaintiff claims Former Michigan State football coach Mel Tucker can’t be found, and that’s holding up a lawsuit filed against him. First reported by The State News, The Detroit News confirmed that nearly six months after Brenda Tracy filed a defamation suit against Tucker, Tracy’s attorney, Karen Truszkowski, claims that Tucker cannot be located after multiple attempts to serve the lawsuit. Truszkowski is now asking for alternate service in an Ingham County Court. In order for a case to proceed, the defendant must be served with a lawsuit, which involves signing a summons to appear in court. This ensures they know that they are being sued and are aware of what the suit entails. In October 2023, just short of a month after firing Tucker, a Michigan State investigation found that Tucker had sexually harassed Tracy while she worked with his football team. Tracy is a rape survivor and activist who speaks with college athletics teams about sexual assault. According to court filings, Truszkowski has attempted to serve Tucker via certified mail at all of his known addresses, including an East Lansing home he still owns. Every letter returned undeliverable without a forwarding address. That same home is where a process server attempted to serve Tucker. Instead, the server found that it was occupied by Tucker’s ex-wife and her mother. According to an affidavit of non-service filed in February, Tucker hasn’t lived at that house since he and his wife divorced more than a year ago. The server claimed that a UPS driver delivering to the address said Tucker no longer lives at the address. Tucker’s own attorneys would not accept service on behalf of their client, either, and that leaves this case at a standstill. He is, however, aware of the case, as he referenced it in a lawsuit against Michigan State University regarding his termination. Tracy and Truszkowski can continue the lawsuit through alternate service, which can include actions such as mailing the case to Tucker’s last known address, tacking it to the door of Tucker’s last known address, publishing it in a legal magazine or any other action the court deems appropriate. Failure to respond to these methods of alternate service results in a default judgment in the plaintiff’s favor.
