Les victimes d’adoptions illégales peuvent être exemptées de toute obligation légale ou morale envers leurs adoptants. Aucune filiation imposée par l’adoption illégale ne doit contraindre les victimes à soutenir ou aider leurs adoptants. Partie 2 /Comment les hautes autorités doivent reconnaître et réparer les victimes d’adoptions illégales ? - Accès aux documents des OAA et adoptants.
La Commission doit pouvoir assister les victimes pour obtenir tous les documents détenus par les OAA, les adoptants ou les administrations, même en cas de refus ou de conflit. Les preuves indirectes — correspondances, échanges administratifs, témoignages — doivent être reconnues pour reconstituer l’histoire des victimes. Les OAA et adoptants sont tenus de conserver ces documents essentiels (tels que définis par le ministère des Affaires étrangères pour le visa long séjour adoption — voir Annexe n°4) et de les remettre aux personnes concernées.
