Masimo sues US Customs over approval of Apple Watch imports WASHINGTON (Reuters) -Medical monitoring technology company Masimo (NASDAQ:MASI) sued U.S. Customs and Border Protection on Wednesday over a decision by the agency that allowed Apple (NASDAQ:AAPL) to import Apple Watches with blood-oxygen reading technology during a patent dispute between the companies. Masimo said in the lawsuit in Washington, D.C., federal court that Customs improperly determined that Apple can import watches with pulse oximetry technology, reversing its own decision from last year without notifying Masimo. Masimo told the court that it learned of the agency’s August 1 decision only after Apple announced it would reintroduce blood-oxygen reading to its watches last week. Spokespeople for Apple and Customs did not immediately respond to requests for comment. A Masimo spokesperson declined to comment. Irvine, California-based Masimo has accused Apple of hiring away its employees and stealing its pulse oximetry technology to use in its Apple Watches. Masimo has separately sued Apple for patent infringement and trade secret theft in ongoing federal court cases. Masimo convinced the U.S. International Trade Commission to block imports of Apple’s Series 9 and Ultra 2 smartwatches in 2023 based on a determination that Apple’s technology for reading blood oxygen levels infringed Masimo’s patents. Apple has continued to sell Customs-approved redesigned watches without pulse oximetry since the ITC (NSE:ITC)’s decision. Apple said on Aug. 14 that it would reintroduce its smartwatches’ blood-oxygen reading capabilities with approval from Customs. Masimo said the agency’s decision to approve the watches without input from Masimo or any "meaningful justification" deprived the company of its rights. Masimo asked the Washington court to halt the agency’s ruling and continue to block Apple from selling watches with the blood-oxygen feature. Apple must pay Optis $502 million lump sum in UK patent dispute, court rules LONDON (Reuters) -Apple must pay a U.S. patent holder $502 million for the use of 4G patents in devices including iPhones and iPads, London’s Court of Appeal ruled on Thursday, in the latest stage of a long-running legal battle. Texas-based Optis Cellular Technology LLC sued Apple (NASDAQ:AAPL) in London in 2019 over its use of patents which Optis says are essential to certain technological standards, such as 4G. London’s High Court ruled in 2023 that Apple should pay Optis a total of $56.43 million plus interest to cover past and future sales over a set period. But Optis argued that was far too low and challenged the decision at an appeal heard in February and March. The Court of Appeal said in a partially-redacted written ruling that Apple should pay a lump sum of $502 million, not including interest, for the period from 2013 to 2027. The lump sum relates to a global licence to use Optis’ patents. An Apple spokesperson said they were "disappointed by this decision and plan to appeal". "Optis makes no products and their sole business is to sue companies using patents they buy," the spokesperson added. "We will continue to defend against their attempts to extract unreasonable payments." Thursday’s ruling is the latest decision in the legal battle between Apple and Optis over the FRAND (fair, reasonable and non-discriminatory) terms to use Optis’ patents.

Lenovo, Ericsson settle international patent dispute LONDON (Reuters) -Lenovo said on Thursday it and Ericsson (BS:ERICAs) had reached an agreement on a global patent cross-licence and to settle all pending litigation, ending a worldwide legal battle. Lenovo sued Ericsson in London in 2023, one of a number of cases brought by one or other of the two companies around the world over 4G and 5G wireless technology. The pair had also sued one another in Brazil, Colombia and the United States, both in North Carolina and at the U.S. International Trade Commission. Their dispute centred on the fair, reasonable, and non-discriminatory (FRAND) terms for a licence to use Lenovo and Ericsson’s patents. Lenovo said on Thursday that it had reached an agreement with Ericsson, with the parties entering into binding arbitration to determine the final terms. Thursday’s announcement comes in the same week that Amazon (NASDAQ:AMZN) and Nokia (HE:NOKIA) said they had settled their global patent dispute.
