Brian Fung onstage with Travis LeBlanc at State of the Net 2025.
Snow day = kiddo is home from school = no Twitch stream during the day today! Might try to hop on tonight instead? If not, then Friday.
Until then, here's me and Travis LeBlanc yesterday at #SOTN2025 📷: Internet Education Foundation
"This is a clear attempt to weaponize our licensing authority," @agomezfcc.bsky.social says at #SOTN2025 of FCC chair Brendan Carr's recent moves to question broadcasters subject to FCC licensing over coverage he sees as biased against Republicans. (Gomez did not name Carr in this 15-minute talk.)
Next up: Rep. Suhas Subrayanyam. Long history in tech at WH and in VA state legislature.
Missed name of interviewer. #SOTN2025
Gomez: We should also focus on reliability and cyber security. Plugs media education and local news.
"Internet should remain, open, dynamic" "free and independent." Should not use regulatory power to "supress dissent, shape speech". #SOTN2025
Gomez: "FCC should not be in the business of micromanaging online speech." #SOTN2025 1A constrains FCC from tilting speech toward one side rather than the other. Will b "losing battle" that will "diminish" role as regulator.
Gomez: Also calls out fear that using threat of Sec. 230 "reform"/regulation is more weaponization. Companies should be allowed to do fact checking, not bullied into removing fact checking tools. #SOTN2025
Sigh. Got here late for Anna Gomez's talk. She explains why FCC independence from the Executive is so critically important.
Calls out FCC "weaponizing" license process and penalizing broadcasters for political speech. "Unclear what we will accomplish if we keep going down this path." #SOTN2025
This morning's #SOTN2025 Keynotes are posted, inc. Beth Williams, Jay Obernolte, Ed Markey, & Marsha Blackburn

CCIA’s Media Advocacy Manager Tricia McCleary is presenting a lightning talk at the State of the Net 2025 conference on Link Taxes and how they impact information access. https://buff.ly/4hr22EJ #SOTN2025
Conversation is lively. What is the speech interest in content moderation? And can you hold platforms to their policy without a court judging the nature of the speech? Can FTC Section 5 (false and deceptive practices) judge when platform is not banning "hate speech?" #SOTN2025
Mere use of prompts is not enough for human creativity. Also note that this going to be reevaluated over time as technology evolves. #SOTN2025
Register of ©, and head of the US @CopyrightOffice, Shira Perlmutter is keynoting #SOTN2025. With the 3d and final part of its AI & Copyright Report coming soon, she's focusing on the impact of generative AI on © and, with it, the future of innovation. Re Fair Use she says...
This lss helpful than one might think, bcause human creativity is often involved in generation of AI. How balance protecting artists v encouraging innovation in creation using AI as tool? Recommend that only copyrightable where human contribution is significant. (Not in the underlying LLM) #SOTN2025
Congress introduced "No Fakes Act," but died last Congress. "Hope it will move forward."
States considering own laws. Unclear how these interact.
Second report is about copyrightability of AI generated content. Reaffirmd that human creativity is necessary for copyrightability. #SOTN2025
Pearlmutter: We got 10K responses to inquiry. No, we did not use AI to analyze them.
Increase in Deep Fake because AI makes it cheap and easy. How do we deal with this? First report analyzed existing state law and found it insufficient. Pushed for Congress to create new law. #SOTN2025
Now up, Shira Pearlmutter the Register of Copyright. #SOTN2025
Brian: Does undermining PCLOB undermine national security?
Travis: Certainly undermines *trust* in ability to protect civil liberties and privacy as part of National Security.
#SOTN2025
Now taking qustions. Nobody had any so Brian continues:
What are you going to do next.
Travis: Considering what to do. Want to push back against the precedent that President can fire PCLOB Commissioners. #SOTN2025
Travis: Very hard to stand up in meeting with WH counsel, Attorney General, and intelligence community and disagree/hold ground on matters of principle. Even harder if you are there alone w/no other Commissioners to support you.
#SOTN2025
Brian: This morning the one remaining Commissioner said "everything is cool." Reply.
Travis: Even if staff does its job, we have one part time Commissioner who may or may not OK that. Cleary not OK.
#SOTN2025
Travis: Part of deal is that PCLOB names people to review commission to certify privacy and a court of review. Getting resignations. Undermines entire data flow agreements. EU could prohibit data flows bcause perceived as Trump puppet. #SOTN2025
Brian: So how this impact our relationship with EU?
Travis: we have an agreement with EU so that we can have data flows between US and EU in compliance with EU data directive. EU now worried we can't be trusted. Also, don't have benefit of PCLOB in discussions. #SOTN2025
Brian: What about fact that Trump willing to ignore courts?
Travis: There is still enormous value in this oversight and airing things in public, even if President will ignore PCLOB's actual outcomes when inconvenient. Most of what PCLOB does doesn't reach courts. #SOTN2025
Brian: How does this help consumers?
Travis: We are talking individual rights in complex space. Without an independent agency, consumers at mercy of whims of President and changes of Admin. #SOTN2025
Brian: We do we care about protecting independence of agency.
Travis: We lose benefit of expertise and debate between majority and minority to air issues. This means that everything will need to be approved by WH (or WH will dictate outcome). Also lose stability. #SOTN2025
Travis: Concerned about coordination between border control and FBI to spy on US citizens on pretext of protecting against immigrants (Not allowed to coordinate with FBI or do domestic spying). #SOTN2025
