The news this week that the Crown Prosecution Service is now providing advice to police investigating Andrew Mountbatten-Windsor and Peter Mandelson suggests that these cases may be entering a more serious phase. It does not mean charges are imminent, but it does indicate that investigators are now working in closer consultation with prosecutors as they assess where the evidence may lead.
It was therefore timely, and a pleasure, to welcome retired policeman Mike Brewer to The Lownie Report podcast this week for a wide-ranging discussion about the police investigation into Andrew, Peter Mandelson and what might be going on behind the scenes.
Mike spent almost 30 years in law enforcement with Avon and Somerset Police, working across areas ranging from counter-terrorism to child abuse, and later led an important historic child abuse investigation in the Falklands.
In this fascinating interview, he brings that experience to bear on the practical realities of a major police inquiry, explaining what an arrest means, why it may have been considered necessary, and how investigators are likely to proceed from here.
We discussed why investigators may have wanted to move quickly to preserve evidence and retain control of the inquiry, with Mike noting that material people assume has been deleted can often still be recovered. He also made the point that it will still be very difficult to successfully prosecute Mountbatten-Windsor and the problems that would emerge if he called the King as a witness.
Mike explained how there will be both covert and overt investigations running in parallel, how police will be weighing up whether Sarah Ferguson is of more use as a witness or whether she may be investigated as a conspirator in Andrew’s crimes, and he also made the point that, despite what many have said about the complexity of prosecuting Misconduct in Public Office, it is actually quite a simple crime to prove.
