In a #USPTO webinar today, #TTAB Judge Casagrande pointed out that failure to function and functionality are not equivalent and, separately, the Office prefers to raise genericness/mere descriptiveness over the broader failure to function basis as a ground for refusal in the first instance.
The TTAB ruled that SWAG GOLF for clothing is likely to confuse with the registered SWAG for belt buckles, citing the dominant element "SWAG" and related goods. A victory for trademark clarity!
