I think the thing that was most surprising to me about today’s oral argument in #USvSkrmetti was the disconnect between the Dem justices’ performative outrage and their evident failure to prepare or even really grasp the nature of the legal issue.

Strangio said at oral argument that they can win on rational basis. If that is not bluster (it is, they probably cant win on heightened scrutiny either this was a terrible case to bring this issue) then people saying this case is decisive are wrong. #UsvSkrmetti

This line of questioning is just so revealing; there are already laws regulating medical care and protecting people from medical malpractice. This law is only about mandating conformity with gender at birth and is designed to discriminate on the basis of sex to achieve that end.

Prelogar is continually trying to offer up an off-ramp to the conservative Justices that would allow them to rule in this case without completely eviscerating constitutional protections from discrimination based on sex in medical care... So far there is no interest in taking that exit.
