مطالعه تطبیقی حقوق معنوی پدیدآورندگان آثار ادبی و هنری و دارندگان حقوق مرتبط حقوق معنوی به مزایای قانونی و غیرمادی اطلاق می شود که به شخصیت پدیدآورنده یک اثر فکری وابسته است. بسیاری از مقررات بین المللی و قوانین داخلی کشورها برای پدیدآورنده آثار ادبی و هنری، حقوق معنوی را شناسایی کرده اند که برخی از آنها دایمی بودن و برخی دیگر محدود بودن مدت حمایت از حقوق معنوی را پذیرفته اند. در مورد حقوق مرتبط (مجاور) برخی کنوانسیونها و پیمانهای بین المللی اساسا به حقوق معنوی نپرداخته اند و قوانین کشورهایی نیز که حقوق معنوی را در خصوص حقوق مرتبط پذیرفته اند آنها را محدود به موارد خاصی کرده اند.در این مقاله پس از بیان مبنا و مصادیق حقوق معنوی، جایگاه آن در حقوق مالکیت ادبی و هنری و حقوق مرتبط (مجاور) در قوانین فعلی مالکیت فکری ایران بررسی می شود. همچنین پیش نویس لایحه مالکیت ادبی و هنری، حقوق مرتبط و قوانین چند کشور خارجی به همراه مقررات کنوانسیونهای مرتبط نیز مورد بررسی قرار می گیرد.
