(1) Second Circuit just denied the Government's panel rehearing requests from May over the decision to deny an emergency stay to the Government. In both Mohsen Mahdawi & Rümeysa Öztürk's cases.
(2) Chief Judge Casper asked for a proposed sked in the severed SEVIS case.

It occurs to me that the transfer case might get back the FRCP 5.2(c) immigration case restrictions and we'll have to figure out what access to the case in D.Mass looks like. Still, a trip to the Seaport is a lot less annoying than a trip to Vermont.
Picking this up two weeks later, as expected, the Government opposes discovery in Rümeysa Öztürk's case. Among other things, they'd like kit to wait until their rehearing petition at the Second Circuit is done. #ozturk

Back at the Second Circuit, they have resolved the motions to expedite in #Mahdawi and #Ozturk, and although not consolidated, will hear the appeals in tandem.
Mahdawi sought 91 days for a response, the court gives 30d for the opening brief, 52d for a response.

And…there we have Öztürk's motion for an injunction restoring her SEVIS record so she can do student "work" and get paid by Tufts. #Ozturk

Upshot of today's hourlong conference in #Ozturk:
• Many proposed conditions relaxed
• May 22 final hearing cancelled
• Plaintiff to file SEVIS status PI motion by next week
• 30 days to file a detailed discovery motion request
• PACER docket access restrictions ordered lifted
Right now Judge Sessions is hearing arguments on whether #ICE gets to impose extra conditions of release on #RümeysaÖztürk, who is already out on #bail.
(Sessions declined to attach ICE conditions at the time of release last week, but said he'd consider a written proposal later).

This is supposed to be about the a dispute on proposed conditions of Öztürk's release, but one might imagine it might exceed that scope, given the delays in her release last Friday.
OK, I've looked at the #Ozturk #134, the "stipulated motion for status conference."
It notes Ozturk's attys want (1) oral argument on conditions of release, AND (2) Discovery sked on the habeas petition (oral args May 22!)
AND (3) restoration of Öztürk's SEVIS status.
MINOR #OZTURK update; On Mon afternoon the Gov. filed proposed conditions of release, and that evening there was joint request for a status conference.
Conditions of release seem (relatively) standard and mild, although she has to notify ICE of out-of-state travel[*], and "surrender if ordered".

Judge Sessions was nominated by President Clinton and confirmed by the Senate in a voice vote. He is an Army veteran and was chair of the U.S. Sentencing Commission. He has been acclaimed by a wide range of attorneys. He is a thoughtful and compassionate man as well.
