HB1113 offers pre-trial diversion for certain misdemeanor offenses and offers accountability and access to services for individuals charged. Pre-trial diversion allows individuals to access treatment and access to services that allow basic needs such as food, hygiene, and shelter to be met. Pre-trial diversion reduces rates of recidivism. Under current law someone currently cited or summoned does not get fingerprinted unless there is a finding of guilt. 5223 would expand the authority of law enforcement to photograph and record fingerprints if a person is cited, released, or issued a summons regardless of an actual finding of guilt. These fingerprints are stored in a national database accessible to ICE and Homeland Security.
