Isgur is such a fucking hack. the case she’s referring to is one where the 5th Circuit entered a stay and it was appealed to SCOTUS. the case in the Times story involved the Court intervening to stay an EPA rule while a lower court was still adjudicating the issue.

It's telling that the entire premise of the shadow docket is that lower courts are incompetent. Not wrong, not the normal judges-can-disagree stuff. SCOTUS is certain the Appellate and District courts are all so truly incompetent that they cannot properly decide injunctions, forcing SCOTUS to act.🙄

Today's #SCOTUS treats *all* coercive relief against the executive branch as imposing irreparable harm on the government. For that proposition, they cite a 2014 opinion by ... Chief Justice Roberts.

Its absence here is deafening.

Just imagine if SCOTUS were an accountable institution where docs were made publicly available after each term concluded.

a major problem with legal advocacy and nonprofits orgs who are still relying on arguing before SCOTUS to at least establish dissents that they hope can be useful in some better future is it makes it self-defeating to speak honestly about the nature of the court. a sign of how imperial the court is.

often what we see is organizations arguing cases to defend say the VRA engage in a kind of “good court, bad boyars” dynamic in which they refuse to forthrightly condemn the current court’s corruption and instead appeal to some idealized version of SCOTUS hoping this genuflecting will get small wins.
