Yesterday, 21 January 2026, the Court of Appeals in Valletta upheld all three terrorism charges against the #ElHiblu3.

The Court corrected a faulty technicality, allowing the charges to stand.

These severe charges should have never been introduced in the first place.

Among other points, the defence argued that proper references to the law were missing in the charges issued against Abdalla, Amara and Kader in November 2023.

The Court of Criminal Appeals will present the decision on Jan 21, 2026.

On 16 December, this years last
hearing in the case of Malta vs #ElHiblu3 took place. The hearing was of great weight as the defence presented their stance on the terrorism charges to the Court of Criminal Appeal.

Furthermore they are attacking that fact that the Attorney General is making reference to actions which are not attributable to them.

The Attorney General argued against the defence's arguments. The courts decision is due on 29 July, 1pm.

Hearing, 12 June

The #ElHiblu3 defence is attacking the terrorism charges against the accused young men, arguing the proper reference to the law were not made in the charges issued against them.

Today, the hearing of Malta against the #ElHiblu3 was postponed again as the Attorney General claims to not have received a notification and therefore was not prepared.

We‘ll continue on 12 June in the courts of Valletta.

Those delays need to stop.

Maltas treatment of these three young men is nothing short of the exemplification of ‘justice delayed is justice denied’. Recent appeals to stop this kafkaesque trial have been dismissed by the Courts of Justice in Valletta.

The three have shown courage and solidarity in preventing an illegal pushback – helping 100 people to reach a #PlaceOfSafety. Nevertheless, they were confronted with charges that have put their lives on hold – they remain in a state of limbo for six years with no end in sight.

Abdalla, Amara, and Kader arrived in Malta on 28 March 2019, as teenagers. They were met with hostility. Based on their efforts in translation and mediation on a ship attempting to illegally return them to Libya, they were arrested and charged with terrorism and hijacking a ship.

On 27 March, it will be exactly 6 years since a group of 100 people were rescued by the #ElHiblu tanker that attempted to illegally return them to Libya. Thanks to the #ElHiblu3, that was prevented. Unfortunately, at the cost of Abdalla, Amara and Kaders freedom. The three remain in a legal limbo.
