The Australian Government and ADF constantly refused to deal with the complaints that were brought to David as a military lawyer in ADF.
He was shut down and locked up.

David is an Australian hero and they should strip Ben Roberts-Smith of all his medals and give them to Dave.

Conclusion
98․ The appellant has not established error in the primary judge’s conclusion in order 1(a) of
McBride (No 2) that the oath of enlistment taken by the appellant does not define the
duty of the appellant for the purposes of s 73A of the Defence Act and s 70 of the Crimes
Act as extending to acting in the Australian public interest, even where in contravention

After a less than one minute session, the three judges of the Supreme Court in Canberra announced that David McBride's appealS had been "dismissed." McBride appeared in the courtroom for the less than 60-second hearing to learn his fate: he is going right back to jail. McBride has nearly five more years in jail to serve for leaking documents to the media exposing Australian war crimes in Afghanistan. This means all of his appeals, including liberation from jail, a reduced sentence or community service were rejected out of hand. McBride waved to his lawyer Eddie Lloyd and just a few of his supporters who found out which courtroom it was in.  Normally a huge board in the lobby of the courthouse posts the names and courtroom numbers on the docket that day.  But McBride's name was nowhere to be found keeping supporters from entering the courtroom. The next step for McBride is to ask leave of the High Court, Australia's highest court, which could take many months for them to respond with no guarantee the High Court would take the case.

The Court of Appeal has dismissed David McBride’s appeal. We are disappointed — but we are not surprised.

As usual, after the judgment, Dvid McBride remained stoic and concerned for others.

“I am concerned for my children and family. 

People who have stood up for what is right in history have suffered far more than I have. I thank god for giving me the strength and courage to fight this battle and the strength to continue this pilgrimage for justice.

It is a great privilege to sacrifice for the country and I am confident the outrage produced by this judgment will be felt by all Australians. I will not give up.”

We are disheartened — because David McBride is still not coming home today. And that is a failure of justice. We are disappointed in the court of appeal in their failure to appreciate the public interest issues in this case and the ramifications this decision has for other Australians.

And that is why we are going to the High Court. 

David said:

‘It is my own conscience and the people of Australia that I answer to. I have kept my oath to the Australian people”

David should never have spent a single day behind bars. Yet as we speak, he is returning to a cold, dark prison cell — preparing for winter in a concrete jungle — while those who committed crimes walk free and those who covered up those crimes have been rewarded with medals and promotions.
