Average participant responses—rescaled to a 0–1 scale—for perceived legal liability, damages awarded, and ethical acceptability, with individual ratings jittered to reveal underlying distributions. All participants evaluated the same alleged trade secret misappropriation: a company replicated a rival’s insurance pricing database using a similar method. The only experimental difference was who performed the act—either a team of human engineers or an AI system. Despite the conduct being identical across conditions, participants in the AI condition were significantly more likely to find legal liability, award higher damages, and rate the behavior as less ethically acceptable.

This study reveals an #AI penalty in trade secret cases, with factfinders more likely to find #liability & award higher damages when AI is used to acquire #tradesecrets, even if conduct matches human methods.
