Alyssa's story on blue and teal background. Until her father passed away 7 years ago, “Alyssa” had been receiving SSI due to her intellectual, developmental, and genetic disabilities. Her benefits then shifted to Childhood Disability Benefits, with her mother as the representative payee. Last September, she received a huge shock when the Social Security Administration sent her notification that, because of her work income, she’d been overpayed in her benefits by over $38,000! In addition to this overpayment request, they’d also cut off her benefits, and Alyssa worried that she would lose her home. On top of this, her financial situation was already difficult as she’d had to reduce her work hours due to her disabilities, AND she’d recently undergone surgery.

While she’d been receiving SSI, her work income was reported, as required, she and her mother were unaware that she’d needed to continue reporting. We argued that Social Security KNEW Alyssa had been working, were fully aware that Alyssa’s mother also had mental health and learning disabilities, and not only did not explain the reporting responsibilities to them, but also failed to conduct a timely work review, which could have reduced the duration and amount of the overpayment. Through vigorous advocacy, Alyssa’s waiver request was granted! Not only was the overpayment waived, but her benefits were restored with a $21,000 payment of back benefits!
