"Das Recht auf Versorgung mit Telekommunikationsdiensten ist mittlerweile in der Rechtspraxis angekommen. Während sein regulatorischer Rahmen sukzessive weiterentwickelt wird, wurden anders als unter dem früheren TKG auch bereits erste Entscheidungen erlassen, mit denen das neue Rechtsinstitut zunehmend an Konturen gewinnt. Blickt man auf die unmittelbaren Ergebnisse, ist das Recht auf Versorgung mit Telekommunikationsdiensten allerdings bisher keine Erfolgsgeschichte. Dabei darf zwar nicht außer Betracht bleiben, dass alleine die Etablierung dieses Rechtsinstituts, die Anhebung des Versorgungsniveaus gegenüber dem TKG 2004 sowie vorbereitende Ermittlungen vor Ort in Einzelfällen zu einer Verbesserung der konkreten Versorgungssituation geführt haben dürften, die sich nicht in der Zahl der förmlichen Entscheidungen niederschlägt. Dennoch ist der Erlass von gerade einmal 29 Unterversorgungsfeststellungen binnen mittlerweile fast drei Jahren bei einem Potential von mehreren hundertausend unterversorgten Haushaltsadressen kein zufriedenstellender Befund."
