Trump Caused and Refused to Stop the Capitol Attack. Smith testified that the investigation's view was that Trump "caused it and that he exploited it and that it was foreseeable to him." Critically, once the attack began, "he refused to stop it. He instead issued a tweet that without question in my mind endangered the life of his own Vice President." When violence was ongoing, Trump "had to be pushed repeatedly by his staff members to do anything to quell it." Even afterward, Trump "directed co-conspirators to make calls to Members of Congress, people who had were his political allies, to further delay the proceedings."
Attempted Destruction of Security Camera Footage. The investigation uncovered that Trump employee Carlos De Oliveira, at Trump's direction, attempted to have surveillance footage deleted. On June 27, 2022, De Oliveira took an IT employee to a small audio closet and "told the employee that the boss wanted the server deleted." This occurred just days after the FBI requested security footage. When the employee said he didn't know how to delete it, "De Oliveira persisted and insisted...that the boss wanted the server deleted and asked, What are we going to do?" Phone records showed Trump had spoken with De Oliveira for approximately 3.5 minutes that same day before this deletion attempt.
Trump Made Threats That Resulted in Death Threats Against Judges and Witnesses. Smith testified that Trump's threatening statements had real-world consequences. After the indictment, Trump tweeted "If you come after me, I'll come after you." He called General Mark Milley "a traitor and mentioned that what he'd done in olden times people would be put to death." As a result, "the judge in this case was put -- received vile death threats." Both the district court and court of appeals found Trump's actions were "causing witnesses to be intimidated and endangering people" and would "chill witnesses who had not yet come forward because they were afraid that they would be next."
Bedminster Classified Documents Incident with Non-Cleared Personnel. At Trump's Bedminster property in July 2021, Trump showed highly classified military documents about a potential attack plan to individuals without security clearances. Smith's testimony referenced the indictment stating that upon greeting a writer, publisher, and staff members, Trump said "Look what I found, this was the Senior Military Official's plan of attack, read it, and just show...it's interesting." The investigation determined that "The PAC Representative did not have a security clearance or any need-to-know classified information about the military operation."
