Being History in the Holy City
The Bells of St. Michaels have made four trips across the Ocean.
I was seated in Fast and French before the last one, five days after Hurricane Hugo, six days after my last shower.
I was drinking good pressed coffee made on their camp stove on the slate sidewalk. Charleston was quiet. No air conditioning hummed. There was no amplified, recorded music. Joe Riley was fighting for the city from his office a half block away, using a monster generator from Fema and computers now in a landfill.
Mayor Riley was wisely, with young greatness, marshalling the power of his city to rise. Charleston was hot, weary and uncertain if the old and delicate place we loved could be salvaged from the wreckage, trash and filth. There were no leaves on the trees of Washington Park. Rats were everywhere, driven from their warrens by water we had not the power to pump away.
A hum rose along the street and the lights of the little, now historic, then upstart cafe flickered to life.
Charlestonians murmured and noted the welcome relief as the ceiling fans spun up and the suffocating air of a City that was too humid and smelled bad began to yield to the power. The door to Broad Street was open. We continued our meals.

They are and until the ocean covers the ground around them, will be one of the voices of Charleston. However, there are other voices, less musical, that must be heard if this old city is to live as more than a plaything of the rich.

Across the Street in the Waring Courthouse, in the very room where Waits Waring declared in a dissent in Briggs vs. Elliot, that Separate Was not Equal, we made our first, incompletely prepared case for the proposition that the City of Charleston has enslaved the voices of its people on a plantation of tourism and real estate development, a people held captive in Confederate Disneyland.
Short of evidence and time we did what we could and Judge Norton did what he had to, turn us down. The Judge who decided in a case about who could be a tour guide by declaring that everyone had the right to tell Charleston's story could not order the city to allow us to protest by the side of a road in a remote part of Daniel Island because we lacked expert proof that the location was not dangerous. We failed to mount the persuasive power to convince Judge Norton that it was our right to risk our lives.
We must, we will, save America from Congresswomen who believe bathrooms are more important than a 3000 point drop in the Dow Jones industrials or the reality that people are being snatched in secret from the Streets of Charleston by agents of a government in the hands of an unfit President.

We must disenthrall ourselves and then we shall save our country." Those words are from Aaron Copeland's Lincoln Portrait. You should listen to it today.

We sought to remind Cadet Mace, of the Citadel Honor Code, "A Cadet will not lie, cheat or steal or tolerate those who do."
We were refused a permit by the city. The Judge could not force Mayor Cogswell to give us one. The city would not even give us permission to hold a reasonably sized rally here today. They will shortly endure the unwelcome voices of the handful of citizens who manage to get a

We have downloaded Judge Norton's Order and put it on google docs so everyone can read it, linked to this post.
We want to thank Judge Norton for the deep attention he give us and our arguments. It's clear he considered both the importance of the goals and our need to be heard.
However as a District Court Judge, Norton is bound to follow the law and precedent. Even if he agrees with us, his court does not ordinarily overturn established law and precedent. The rules are, and have to be highly technical and reflect 40 years of increasing hostility towards freedom of speech and assembly by the US Supreme Court, which unlike Judge Norton, has the authority to make and change the law.
We'll be discussing his order at Container Bar after our Tuesday, April 8 Demonstration "Wise Counsel for a Holy City." We learned a lot, including who we can't count on.
The case will continue. We will all master the law and muster the evidence together. We will win this case.
However, just as Judge Norton must do his job and follow the rules, so must all of us. If we do not learn and change, rapidly, the law cannot stand up as our friend and our freedom of speech in the City of Charleston will slip away.
We congratulate the participants in the massive rally in Summerville which was attended by more of our own members than our small, symbolic demonstration on Daniel Island. However we had Alan Morris' Nancy Mace cardboard cutout in a chicken hat and the Mother of the Movement so we're proud of our choice. We're glad you had a choice as well.
