It's quite clear to all legal scholars of the time, including abolitionists like Danl Webster,that the #USConstitution itself was exactly an enabling law requiring northern states to recognize #replevin & #trover in humans, abolished by 1701 Holt & 1772 Somerset v Stewart respectively.

It still is.

That's what #GeraldHorne believes. In 1772 the English courts in Somerset v Stewart had ruled chattel slavery had been outlawed in common law since 1066, so #replevin and #trover in humans could not be a thing: "slave catchers" were kidnappers whose actions had to follow due process in each colony.
