Canva for NJ.com By Star-Ledger Guest Columnist The undersigned faculty members of Seton Hall Law School write in our individual capacities to denounce the federal government's sustained campaign of brutality, ongoing violations of civil rights, repeated affronts to human dignity, and complete disregard for the principle that no one is above the law. We condemn these actions whether they take place in our state or others and call upon government officials to stop these abuses immediately and to ensure accountability for those responsible. The federal government is systematically violating core constitutional protections. • The government has violated the First Amendment by attacking and seizing peaceful protesters and legal observers.
We condemn these actions whether they take place in our state or others and call upon government officials to stop these abuses immediately and to ensure accountability for those responsible. The federal government is systematically violating core constitutional protections. • The government has violated the First Amendment by attacking and seizing peaceful protesters and legal observers. • The government has violated the Fourth Amendment by conducting warrantless home raids and arresting and detaining people without probable cause. • The government has violated the Fifth Amendment by denying due process of law and detaining individuals based on racial profiling. These and other constitutional protections and core principles of our nation have been disregarded by our federal government. In this statement, we are not debating abstract legal principles. We are calling out well-documented acts of lawlessness by federal officials that have inflicted severe and widespread harm. Protestors have been killed in our streets. People in custody of the federal government have died. We have seen extraordinary cruelty, including an elderly citizen in minimal clothing pulled from his home in subfreezing weather and children detained on their way home from preschool.
When asked to account for these actions, the government's response has been dishonest. Senior members of government have misrepresented facts to the public and to the courts. We are particularly disturbed by senior government officials blatantly misrepresenting events to portray victims as criminals. These tactics are hallmarks of authoritarianism and are incompatible with constitutional democracy and our most basic commitments to human dignity. We therefore call on the government to stop these abuses, transparently investigate alleged crimes, and hold accountable every person in the chain of command who is responsible. Finally, we recommit ourselves as lawyers and educators to preserving democratic principles as we bear witness to the government's abuses of power. We will continue to educate our students and our community about constitutional rights, and we will support education, legal observing, pro bono work, and other lawful efforts to curtail further violations. We encourage readers to join us in becoming critically engaged, and to contact their congressional representatives.
