While smart data schemes typically involve the sharing of data about the customer, complementary open data initiatives (e.g. the Fuel Finder scheme) illustrate how smart data powers in the Data (Use and Access) Act can also support broader market transparency and efficiency. These initiatives share the common goal of using data to drive better decision-making and consumer outcomes and may inform future smart data applications. Smart data is not primarily focused on public sector data, but certain use cases could be enabled or enhanced by it.

By the end of 2025, we expect to commence the majority of the Digital Verification Services and the Digital Economy Act 2017 measures. These will be delivered through separate sets of regulations, which are currently expected to be made before the end of this year. In early 2026, we plan to commence the majority of the data protection provisions outlined in Part 5 of the Act, except for the provisions requiring data controllers to establish effective procedures for acknowledging and resolving complaints, which will be commenced approximately12 months after Royal Assent. Provisions on information standards for health and adult social care in England, as set out in Part 7, will be commenced alongside most of the data protection measures early in the New Year. Later in 2026, the Government will commence certain provisions requiring longer leadin times. These include measures on the National Underground Register in Part 3, and the electronic system of registering births and deaths in Part 4, which rely on the appropriate technology being in place. Changes to Information Commissioner's Office governance structures in Part 6 will take place once members of the new Board have been appointed, which is expected to be by the Summer 2026.

A PT scheme can expand on the economy wide requirements set by the DMCC Act or existing sector regulations and be an effective way to address specific price transparency concerns in appropriate markets – particularly those where it can be difficult to search and compare options. We are defining PT schemes as initiatives that require participating businesses (i.e. data holders in the DUAA) to share standardised price information (and any additional information determined necessary by policymakers), with an aggregator – which in turn makes that data freely available (e.g. via an API). This data can then be accessed by ATPs to provide comparison services (potentially combining with other public data sources). An example of this is the planned fuel finder scheme.
