There is no chance SCOTUS would let this stand because the current system favors Republicans. They will say that while states can decide how to distribute their EVs, it must be based on the vote in that state and not based on how people in other states vote. And that's not a crazy argument.

Two markers stood in Colfax, Louisiana honoring the whites who perpetrated the massacre and the three whites who died. One marker was at the Courthouse site of the Massacre, the other in the local cemetery and explicitly said those who died were fighting for "white supremacy."

Afterwards, 3 people were convicted in federal courts for the Massacre, but SCOTUS overturned their convictions on the grounds the 14th Amendment didn't apply in this case and thus there was no federal jurisdiction. Of course local courts later handed out no punishment to those men.

Today is the anniversary of the Colfax (Louisiana) Massacre. White supremacists, the KKK, and ex-Confederate soldiers slaughtered up to 150 freed slaves and politicians who supported their civil rights. It ushered in the Jim Crow ara and most Americans are never taught about it.
