To be absolutely clear, I will reiterate that copyright law in the UK is unchanged. Works are protected unless one of the existing exceptions, which have existed for some time, such as exceptions for teaching and research, applies, or the rights holder has granted permission for their work to be used. That is the law. What we are working to provide is an approach that delivers not only legal certainty in the abstract, but also practical certainty in a copyright regime that is respected and enforceable, while still balancing the needs of copyright owners as well as copyright users.

Earlier this month, the House of Lords dealt a fourth defeat to the government over its plans to allow tech companies to use copyrighted material to train their models. Peers backed calls for greater transparency after musicians such as Sir Elton John also warned of the threat to creative industries. The Data (Use and Access) Bill has now been returned to the Commons. The Department for Science, Innovation and Technology said it is carrying out a wider consultation on these issues and will not consider changes to the Bill unless they are completely satisfied that they work for creators.

Last week, I covered some misconceptions about the contents of the Bill and what we are trying to achieve separately in relation to artificial intelligence and copyright. I fear that some of those misconceptions persist. The Guardian carried the following sentence this weekend: "The AI Bill, which proposes allowing tech companies to use copyrighted material, has suffered a fifth defeat in the Lords." That was repeated by one of the presenters on the "Today" programme, who stated that the Bill allows AI companies to use copyright material. I am glad the "Today" programme has apologised and corrected the record. Let me reiterate: this is not an AI Bill and it does not propose changing copyright in any regard whatsoever. If the Bill goes forward in the way proposed by the Government, there will be no diminution in the robustness of the UK copyright regime. Sometimes I want to say, in the words of Richard II, "you have mistook us all this while."

Ministers have been locked in a battle with critics in the House of Lords over whether AI is unfairly being trained on creative material without credit of compensation. Its data bill allowing copyrighted material to be used unless the rights holder opts out passed its final stage this week in a defeat for those fighting for further protections. The issue has caused a fierce backlash from the creative sector, with artists including Elton John, Tom Stoppard, Paul McCartney and Kate Bush throwing their weight behind a campaign to protect copyrighted material.

An AI regulator is the critical component of a private AI regulation Bill that Lord Holmes has introduced. "Don't think big, not a do-it-all-regulator, but an agile, nimble, horizontally focused authority to be the custodian of the principles of UK AI regulation and a centre of excellence and expertise that all the other industry specific regulators could draw upon. Lord Berkeley of Knighton (CB) My Lords, the noble Lord, Lord Knight, misses one or two points. My noble friend Lady Kidron has made it clear that this is her last stand, so nobody is suggesting that noble Lords are going to try to defeat this Bill. Indeed, I do not think any of us would want to do that.
This intervention comes as a surprise. Lord Berkeley spoke on AI and copyright in the past several Data Bill debates, but he isn't one of the obvious headbangers members.parliament.uk/member/4276/...
Last week he seemed in tune with Kidron's decision not to press further.

Communication on this was haphazard at best. The invitations to committees were sent to generic inboxes on Friday evening, with our acceptance—and resources—taken for granted in a broadcast to all colleagues on Saturday morning (albeit otherwise more informative). And all for a matter to be debated tomorrow, Tuesday. The framing of the proposal is not at all clear on constitution and status, eligibility and protocols for participation, time commitment, objectives and potential outputs. Even the title is confusing, suggestive of a new parliamentary body with a remit to consider, develop and produce something, but "set up and run by DSIT". Parliament already has bodies which — as your letter kindly acknowledged — work tirelessly at scrutiny, two of which — the Science, Innovation & Technology, and Culture, Media & Sport, Committees — have already taken evidence jointly, incidentally with the self-same title as your proposal, AI and copyright, likely only to add to confusion about the provenance and role of the new body. The letter from Minister Bryant, received on Saturday 7 June by all colleagues referred to "seeking expertise from the Commons DSIT and DCMS select committees and the Lords Science and Communications Committees" it would be helpful to have a clear indication of what is intended in this regard.
