A research project to evaluate the Data (Use and Access) Act 2025 (DUAA) and the Privacy and Electronic Communications Regulations 2003 (PECR). The project involves both compiling existing evidence, (literature reviews, and quantitative analysis) and novel research (interviews) to baseline the impact of DUAA's data protection reforms, and to conduct a post-implementation review of PECR. Outputs will be evaluation reports, Post Implementation Review, interview summaries, metrics for ongoing monitoring, and recommendations for future research.

Clause 115 of the previous DPDI Bill extended the 'soft opt-in' for email marketing for charities and other non-commercial organisations. The DMA estimates that extending the soft opt-in to charities would increase annual donations in the UK by £290 million. At present, the DUA Bill proposals remove this. The omission of the soft opt-in from will prevent charities from being able to communicate to donors in the same way as businesses can. As representatives of both corporate entities and charitable organisations, it is unclear to the DMA why charities should be at a disadvantage in this regard.

There are various types of non-profit who might wish to send promotional emails and text messages to individuals, but which don't as a rule sell products or services. Perhaps the most obvious of these are charities, but political parties also fall into the type. The Information Commissioner has long held that promotional communications sent by such non-profits do constitute "marketing" (and the Information Tribunal has upheld this). But the combined effect of regulation 22(3) and the interpretation of "marketing" as covering promotional emails and text messages by charities, means that those charities (and political parties etc.) can’t send soft opt in communications.

Answer Chris Bryant Labour, Rhondda and Ogmore Commons There is a balance to strike between driving growth and innovation whilst ensuring people retain appropriate choice and control about how their personal data captured by cookies is used. While we have not added this exemption to the face of the Data (Use and Access) Bill, we have taken power in new regulation 6A to extend or modify the list of exemptions. We have already begun talking to industry and others about the possible use of this power and will continue to do so. This change would require careful consideration and consultation.
