If the new Bill C-22, the Lawful Access Act 2026 becomes the law, the government of Canada will be able to secretly order Apple to build a capability into its infrastructure to allow Canadian law enforcement and national security folks to track every iPhone, iPad, Apple watch, Apple AirPod and AirTag in real time. Then they’ll be able to require Apple to confirm whether they provide you any services. Then they can go to a justice of the peace and get an order – without actually believing that a crime has been or will be committed – requiring Apple to hand over EVERY device identifier for every device you use with their services. That’s the digital ID for your iPhone, iPad, Apple watch, Apple AirPod, Apple TV and AirTag. With that information, they can go back to the judge and get an order – again without actually believing that a crime has been or will be committed – requiring Apple to give them the moment-by-moment locations of all your devices. Oh, and that secret order also required Apple to keep your location history for a full year, so cops can get that too. Is that a power we want Canadian police and law enforcement to have?

Yes, the new #lawfulaccess bill, #BillC22, is much less worse than #C2 but I am really tired of its defenders who clearly don't know what it actually says making up justifications that are not addressed in the bill. I'd wager that Ottawa Police Chief either hasn't read it or doesn't understand it.

But one of the core things that it includes is something called lawful access. Now, lawful access is through the courts, getting a warrant, but being able to access messaging between suspected criminals and these individuals know from their investigations, from their prosecutions, that what we see in extortion is very often through private messaging services. During his speech in Surrey this morning, Carney talked about moving ahead on #LawfulAccess. As a reminder, Lawful Access has *twice* been ruled unconstitutional by the Supreme Court of Canada.
I have some concerns about what they plan to do about private messaging services here.
Unless there's an early election, I'm 99% confident that #LawfulAccess will be back. I expect that there will be improvements that make it palatable for those who care about the Charter, but the gov't has not made the case for mandatory, secret back doors. nationalpost.com/news/politic...

So it appears that the government has not abandoned #lawfulaccess, but have effectively split their border bill in two. The new #BillC12 includes all the old stuff other than lawful access and they'll push forward with lawful access in #BillC2 www.cbc.ca/news/politic...
