Labour's off-rolling crackdown could finally "shed light on a practice that is currently invisible" but must be supported by councils and trusts to work, experts have said. 

The schools white paper unveiled plans to tighten up scrutiny over pupil movements, and to interrogate the leaders of schools suspected of illegal exclusions or other shady methods to skew cohorts. 

Kiran Gill, chief executive of inclusion charity The Difference, said this "has been an area of insufficient data accountability". 

"It shouldn't be up to investigative journalists or brilliant statisticians to highlight where there's a system challenge."

182. It is clear to us that CPOMS is a data recording system which is primarily used by staff to record concerns about children. During the period November 2021 to April 2022 the Claimant accessed CPOMS on 15 separate days and never logged one piece of data about any concerns she had regarding Child X. Instead she effectively covertly monitored Child X. She also transferred data regarding Child X from the School IT system onto her personal computer, then onto a memory stick. She then proceeded to share Child X’s data with her Solicitor.

Wellsway School in Keynsham, near Bristol, has been reported to the Information Commissioner's Office after 86,000 lines of sensitive information was emailed to a couple.

They were sent the data after they submitted a Freedom of Information request because they felt the secondary school's withdrawal room was being used excessively.

The school said it had "immediately followed through with all procedures and informed parents" when it became aware of the date breach. [sic]

It was only after having the spreadsheet of data for a few weeks that the couple, who wish to remain anonymous, realised it contained comprehensive data on children.

As well as their name and date of birth, it listed whether they were considered to have special educational needs or be on an educational health and care plan.

This means the 7% do not have national pupil records and there is a two-tier level of better data protection. This also affects research. The Department for Education has awarded Faculty AI a £3m contract to build a “content store” to pool information about the curriculum and anonymised pupil assessments. This data will then be used to develop tools that teachers can use, such as AI bots for marking homework or generating lesson plans.

A procurement notice published earlier this month showed that Faculty won the contract, which is scheduled to run until September 2025.

A Faculty spokesman said the company was working with a law firm to ensure proper safeguards around student data, and that content from pupils would only be used with parental consent, and would be anonymised.
