SB 5974 is a simple, common sense bill. Today about 95% of all law enforcement personnel are fully within the scope of the existing system in Washington State. This legislation simply requires that all police sheriffs, marshals, and volunteers comply with existing legislation for background checks, training, and certification.

This legislation will make it clear that the law covers sheriffs, police chiefs, and town marshals and brings reserve officers and volunteers into the same system. This law will increase public trust in law enforcement, improve police accountability, and improve public safety.

Anyone can run for sheriff. This law will simply ensure that a sheriff would have to pass a background check and go through academy training within 12 months of taking office.

Sheriffs would still be allowed to use volunteers for search and rescue, events, and natural disasters. This legislation would require that any volunteers using police authority must be certified.

ESSB 5925 bill allows the Attorney General’s office to investigate police agencies for systemic practices that violate citizen rights as protected by the Washington State Constitution.

At present the only way to hold police departments accountable for practices of discriminatory policing is for the US Department of Justice (DOJ) to bring a lawsuit or consent decree to affect change. The Trump administration has ordered a halt to pursuing federal consent decrees.

A public records exemption removes transparency.

3. Amend the bill to eliminate direct vendor access.

Direct vendor access creates a giant loophole that will be exploited to terrorize immigrant communities, pursue those seeking protected healthcare, and violate fourth amendment and free speech rights.

The Driver Privacy Bill was intended at harm reduction but created loopholes that can be exploited and allow invasive location tracking of vulnerable groups.

This is why we had recommended the Senate strengthen the bill and adequately protect Washington residents from harm.

The bill should be amended to disallow third party vendors from accessing the data. Allowing third party vendors to access the data creates a giant loophole that will certainly be exploited.

Under current law someone currently cited or summoned does not get fingerprinted unless there is a finding of guilt.

5223 would expand the authority of law enforcement to photograph and record fingerprints if a person is cited, released, or issued a summons regardless of an actual finding of guilt.

These fingerprints are stored in a national database accessible to ICE and Homeland Security.

Number of per capita officers has NOT been shown to decrease crime rates and ESHB 2015 will NOT achieve the legislature's goal of increasing public safety.

Instead, Washington State should invest in upstream preventative solutions such as affordable housing, direct cash assistance to those in need, violence interruption programs, substance-use disorder treatment and other evidence-based interventions that have been shown to reduce community violence.

PRO HB1113: Public Safety Act

PRO HB1113: Public Safety Act

HB1113 offers pre-trial diversion for certain misdemeanor offenses and offers accountability and access to services for individuals charged.

Pre-trial diversion allows individuals to access treatment and access to services that allow basic needs such as food, hygiene, and shelter to be met. Pre-trial diversion reduces rates of recidivism. It puts individuals on a pathway to recovery, reduces the harm of the criminal legal system, and increases community safety.
