Volkswagen liable for defeat devices, top EU court rules BRUSSELS (Reuters) -The European Court of Justice on Friday ruled that carmakers like Volkswagen (ETR:VOWG_p) remain liable for using unlawful defeat devices, such as temperature-sensitive emissions software, even if the vehicles met EU standards, which doesn’t guarantee the technology’s legality. The case at the European Union’s top court arose from two German lawsuits involving Volkswagen diesel vehicles fitted with defeat devices, either during production or through later software updates. The Court said compensation to buyers can be reduced based on vehicle use or capped at 15% of the purchase price, but it must still adequately reflect the damage caused. "The impact on Volkswagen is expected to be limited, as only a few diesel-related lawsuits are still pending before German courts," Volkswagen said. "In our view, today’s ECJ decision will not change that," the German carmaker added. Defeat devices are tools or software that alter vehicle emissions, triggering legal disputes over whether manufacturers misuse them to conceal true pollution levels. Carmakers have argued these devices only activate at certain temperatures to protect the engine and comply with the law. Volkswagen was found to have hidden excessive levels of toxic diesel emissions in 2015, a scandal that led to a management rout and thousands of regulatory probes and lawsuits which are taking years to settle.

Europe’s CISPE challenges Broadcom’s $69 billion VMware deal in EU court (Reuters) -European Union judges could review chipmaker Broadcom (NASDAQ:AVGO)’s $69 billion acquisition of cloud computing firm VMWare, after an antitrust complaint opposed the bloc’s approval of one of the biggest takeovers in the technology industry. The Cloud Infrastructure Services Providers in Europe, or CISPE, has filed a formal appeal before the European General Court seeking an annulment of the European Commission’s approval of the deal, the organisation said on Thursday. Broadcom had wrapped up the purchase of VMWare in November 2023, after intense scrutiny from regulators globally forced the company to delay the closing date thrice. The European Commission’s official summary of its approval decision was published in May, acknowledging that the acquisition posed significant risks to competition. "However, it failed to impose any conditions on Broadcom to prevent a concentration of dominance or to mitigate the potential abuse of such a position," CISPE said. CISPE said it has "consistently raised alarms" with the Commission over Broadcom’s unfair software licensing practices, but no substantive action has been taken to support either European cloud service providers or their customers. VMware’s dominance of software in the virtualisation market "means that unfair new licensing terms enforced by Broadcom affect almost every European organisation using cloud technology", said Francisco Mingorance, Secretary General of CISPE. A spokesperson for the European Commission said it is ready to defend its decisions in court. "Broadcom strongly disagrees with these allegations," a company spokesperson said, adding that the deal was approved after a "thorough merger review process, and we will uphold the commitments made to the Commission at that time." Ferrari wins back rights to Testarossa brand at EU court AMSTERDAM (Reuters) -Ferrari on Wednesday scored a win at the EU’s second-highest court, which said the luxury sportscar maker had been wrongfully stripped off the rights to the Testarossa brand name. Ferrari’s rights on the mark were revoked in 2023 by the European Union’s Intellectual Property Office, which said the company had not put them to "genuine use" for a continuous period of five years between 2010 and 2015. But the EU’s General Court annulled that decision, stating that Ferrari had used the trade mark, through giving explicit or implied approval to dealers selling second-hand Testarossas and through licensing the brand for scale models. "The use of the trademark to guarantee the identity of the origin of the goods for which it was registered, when reselling second-hand goods is capable of constituting genuine use," the court said. Ferrari built its iconic Testarossa cars, made famous by the 1980s TV show ’Miami Vice’, between 1984 and 1996, and now only second-hand models are available. Its rights to the brand name had been challenged by the head of German toy maker Autec.

Google faces setback as EU court adviser backs antitrust regulators BRUSSELS (Reuters) -Alphabet’s Google faced a potential setback on Thursday as an adviser to Europe’s highest court sided with EU antitrust regulators in the company’s fight against a record 4.34 billion euro ($4.98 billion) fine levied seven years ago. The European Commission in its 2018 decision said Google had used its Android mobile operating system to block rivals. A lower tribunal endorsed the EU finding in 2022 but trimmed the fine to 4.1 billion euros, prompting Google to appeal to Europe’s top court. Advocate-General at the Luxembourg-based Court of Justice of the European Union (CJEU) Juliane Kokott, in her non-binding opinion, advised the court to dismiss Google’s appeal and confirm the reduced fine set by the lower tribunal. "The legal arguments put forward by Google are ineffective," she said. Kokott dismissed Google’s argument that regulators should compare Google with a rival in assessing the situation. "It is not realistic, in the present case, to compare the situation of Google with that of a hypothetical as-efficient competitor. Google held a dominant position in several markets of the Android-ecosystem and thus benefited from network effects that enabled it to ensure that users used Google Search," she said. Judges, who usually follow four out of five such non-binding opinions, will rule in the coming months. "Android has created more choice for everyone and supports thousands of successful businesses in Europe and around the world," a Google spokesperson said on Thursday. "We are disappointed with the Opinion which, if it were followed by the Court, would discourage investment in open platforms and harm Android users, partners and app developers." Regulators said Google’s illegal practices dated back to 2011, as it required manufacturers to pre-install Google Search and its Chrome browser together with its Google Play app store on their Android devices. It paid them to pre-install only Google Search and blocked them from using rival Android systems. Google’s Android system, which it lets device makers use for free, runs about 73% of the world’s smartphones, according to Statcounter. Volkswagen, Stellantis and other carmakers hit with $495 million EU cartel fine By Foo Yun Chee and Makini Brice BRUSSELS (Reuters) -Volkswagen, Stellantis (NYSE:STLA), 13 other carmakers and their car association were fined a total of 458 million euros ($495 million) by EU antitrust regulators on Tuesday for taking part in a vehicle recycling cartel. The European Commission, which raided the companies three years ago, said the cartel, which involved end-of-life vehicles, took place from May 2002 to September 2017, with automakers association ACEA (BIT:ACE) organising meetings and contacts between the companies. End-of-life vehicle recycling is when cars are dismantled and processed for recycling and disposal once they are no longer fit for use. The EU competition watchdog said the companies agreed not to compete with each other in advertising the extent to which their cars could be recycled and agreed to keep quiet on how much recycled materials are used in new cars. They also agreed not to pay car dismantlers for processing the end-of-life vehicles. EU laws require carmakers to bear the costs of recyling such vehicles if needed, allowing car owners to dispose of cars free with a dismantler. "We will not tolerate cartels of any kind, and that includes those that suppress customer awareness and demand for more environmentally friendly products," EU antitrust chief Teresa Ribera said in a statement. Volkswagen (ETR:VOWG_p)’s fine was the biggest at 127.69 million euros, followed by Renault-Nissan at 81.46 million, Stellantis at 74.93 million and Ford at 41.46 million. Other penalised members of the cartel included Toyota (NYSE:TM), Mitsubishi, Honda (NYSE:HMC), Hyundai (OTC:HYMTF) , Jaguar Land Rover, Mazda, GM, Suzuki and Volvo (OTC:VLVLY).
