Public Schools without the requirements of the Depart of Ed could: Reject a child with disabilities, Fail to provice evaluations to determin instructional needs. End IEPS. Remove children from the general ed setting. Ignore parents. End IDEA safeguards to protect students' and parents' rights.

If states aren’t legally bound to provide these services for students with disabilities with a federal mandate, they will likely not continue them without a Department of Education!
